As used in this chapter, the following terms shall have the meanings indicated:
BARBER
Any person who is licensed to engage in any of the practices encompassed in barbering.
BARBERING
Any one or combination of the following practices when done on the human body for cosmetic purposes and not for the treatment of disease or physical or mental ailments and when done for payment either directly or indirectly or when done without payment for the general public:
A. 
Shaving or trimming of the beard, mustache or other facial hair;
B. 
Shampooing, cutting, arranging, relaxing or styling of the hair;
C. 
Singeing or dyeing of the hair;
D. 
Applying cosmetic preparations, antiseptics, tonics, lotions or creams to the hair, scalp, face or neck;
E. 
Massaging, cleansing or stimulating the face, neck or scalp with or without cosmetic preparations, either by hand, mechanical or electrical appliances; or
F. 
Cutting, fitting, coloring or styling of hairpieces or wigs, to the extent that the services are performed while the wig is being worn by a person.
BARBERSHOP
Any establishment engaged in the practice of barbering for the public.

No barbershop shall be operated in the Town without the operator thereof having first obtained a license from the Division of Licensing, Department of Revenue and Finance.

The fee for a license for a barbershop, beauty shop or unisex shop, to be obtained from the Division of Licensing, shall be $421 for an initial license and $128 per year thereafter, and such license shall be renewed on or before the second day of January of each year. Such license shall be displayed in a conspicuous place in the shop.

Every barbershop in the Town shall be open to the Department of Health for inspection at any time and shall comply with the provisions of this chapter.[2]

A. 
The hour for opening barbershops shall be 8:00 a.m. and the hour for closing the same shall be 8:00 p.m., Eastern standard time (or daylight saving time, when in effect), except:[1]

(1) 
Permission is granted for those clients of beauty salons who have entered same prior to the required closing time to remain up until the hour of 9:00 p.m. After 9:00 p.m., all customers must vacate the establishments.

B. 
All barbershops shall be closed all day on New Year's Day, Washington's Birthday, Memorial Day, July 4, Labor Day, Thanksgiving Day and Christmas or on those days that the aforementioned holidays are nationally celebrated by federal or state proclamation.

It shall be unlawful for any proprietor, manager or other person to open or keep open on the first day of the week, commonly known as "Sunday," a barbershop or other place wherein the business of shaving, haircutting or other barbering is carried on within the Town.
It shall be unlawful for any person on the first day of the week, commonly known as "Sunday," to do any shaving, haircutting or other barbering in any barbershop or other place of business in the Town.
A. 
The clear interior view of every barbershop or other place wherein the business of shaving, haircutting or other barbering is carried on within the Town shall, on the first day of the week, commonly known as "Sunday," be in no way obstructed by a screen, nontransparent glass, shade, blind, door, shutter or merchandise or any other article placed therein.
B. 
The entire interior of every barbershop or other place wherein the business of shaving, haircutting or other barbering is carried on in the Town shall, on the first day of the week, commonly known as "Sunday," be open to full view from the public street.
In the event that any barbershop shall use window lights, illuminated barber pole or any other electrical device or sign used to designate a barbershop, the person in charge of such barbershop shall, at the closing hour specified in § 174-5, immediately disconnect the electric current or any other means used to illuminate the aforesaid devices or signs. In addition thereto, at least one window or door with glass partition shall remain uncovered so that the interior of such barbershop may be fully visible from the outside thereof.
Wherever a screen door shall be used in lieu of a wooden or metal door for the purpose of egress and ingress, such screen door at closing hours shall immediately be bolted from within so as to prevent any person from entering the barbershop.
