The provisions of this chapter shall apply to all Borough employees, including the Board of Health, excepting part-time employees, the Borough police officers, the Chief and Captain of Police and the Department of Public Works who are covered under separate collective bargaining agreements. The Borough of Kinnelon Personnel Policy does not apply to the Kinnelon Public Library, which operates under separate but similar policies.

The Borough of Kinnelon Personnel Policy, dated March 2010,[1] is hereby adopted by the Borough of Kinnelon, and its provisions as may be amended from time to time shall be deemed controlling with respect to all matters addressed therein, particularly the rights, duties, benefits, terms and conditions of employment and evaluation procedures for those employees specified in § 53-1.

A. 
Filing of personnel policy. Upon introduction of this chapter, and at all times thereafter, three copies of the personnel policy shall be kept on file with the Clerk of the Borough employees. Additionally, the Borough Clerk shall keep on file all amendments to the personnel policy that may be promulgated from time to time, as well as any explanatory material or interpretations of the policy that may be promulgated by the Borough Council.
B. 
Distribution to employees. The department supervisor of each full-time and permanent part-time Borough employee shall provide each employee with a copy of the personnel policy, as well as any future amendments thereto, including explanatory material or interpretations of the policy that may be adopted by the Borough Council. Each full-time employee is responsible for the manual assigned to him/her and shall acknowledge receipt and review of the manual by returning a signed acknowledgment form.

The governing body may amend the personnel policy from time-to-time by resolution. Any amendments shall be effective immediately, unless the governing body deems it desirable to delay the implementation of the amended provision, in which case, the effective date of the amendment shall be set forth in the resolution.
The adoption of this chapter, and specifically, the adoption of a new Personnel Code, is not intended to affect the accrued rights and benefits of employees under the prior Personnel Ordinance with respect to items including, but not limited to accrued sick time, longevity, vacation time and other benefits, which shall remain unchanged and shall continue in effect.

Pursuant to N.J.S.A. 43:15C-2, and except as otherwise excepted pursuant to N.J.S.A. 43:15C-1 et seq. and the guidelines established by the Local Finance Board pursuant to N.J.S.A. 43:15C-2a.(3) (See, for example, Local Finance Notice 2008-10, April 28, 2008, attached to this Ordinance as Exhibit A.[1]), the following positions are deemed eligible for and shall participate in the Defined Contribution Retirement Program:
