The following subsections comprise the employment
benefits and terms of employment of the positions of Chief of Police
and Lieutenant ("administrative officers" herein), to the extent that
the same are not contained in any agreement or written contract.
A. Anniversary date. The anniversary date shall be determined
on the same basis as that set forth in the current police officers'
collective bargaining agreement ("agreement" herein).
B. Salary. The salary for the administrative officers
shall be set by annual salary ordinance; in determining the applicable
salary, the Council shall comply with the provisions of P.L. 1991,
c. 176 (S-420).
C. Holidays. The administrative officers shall not be
entitled to paid vacation days over and above salary. Any payment
previously designated and due as holiday pay has been included in
the administrative officers' salary. There shall be no compensatory
time allowed in the event that any work is performed by the administrative
officers on a holiday. Any payment previously designated and due as
compensatory pay has been included in the administrative officers'
salary.

D. Vacations. The vacation eligibility for each administrative
officer shall be determined in accordance with the current agreement,
based upon the years of employment. Unused vacation time up to a maximum
of 10 days may be carried over to the next calendar year or may, at
the option of the officer, be turned in to the Borough for payment
at the end of the year in which the days were accumulated.
E. Personal leave. Bereavement leave for the administrative
officers shall be permitted to the same extent, and upon the same
terms, as is set forth in the current agreement. The administrative
officers shall be allowed the same number of personal days as is set
forth in the current agreement, which leave shall be noncumulative.
F. Uniforms and equipment. The administrative officers
shall each receive an annual clothing allowance of $700, in addition
to their other aspects of compensation.
G. Educational incentive. The administrative officers
shall not be entitled to receive any financial incentive over and
above their salary for college credits or college degrees. Any payment
previously designated or due as educational incentive has already
been included in the administrative officers' salary.

H. Health and life benefits. The administrative officers
shall receive the same health and life benefits as set forth in the
agreement.
I. Longevity. The administrative officers shall not receive
any payments for longevity over and above their salary. Any payments
previously designated or due as longevity have already been included
in the administrative officers' salary.

J. Physical examination.
(1) Each administrative officer shall undertake at the
expense of the Borough a physical examination to be performed by a
physician or group of physicians to be selected by the Borough. Each
administrative officer will be required to comply with any recommendations
made by the examining physician.
(2) A physical examination shall be taken every other
year unless otherwise directed.
K. Sick leave/terminal leave.
(1) The administrative officers shall be entitled to sick
leave with pay based on their aggregate years of service. After the
first year of employment, each administrative officer shall be entitled
to 15 days' sick leave per year for each year of service. One hundred
forty-five days of unused sick leave may be accumulated from year
to year. Commencing January 1, 1982, and after said administrative
officer has accumulated the maximum 145 days provided for above, each
administrative officer may accumulate his entire unused sick leave
in any calendar year commencing in 1982; provided, however, that said
administrative officer shall only be permitted to so accumulate if
he has not used more than five sick days of sick leave in that particular
calendar year.
(2) Provided that the administrative officer complies
with the notice requirements set forth below, at the time of his retirement,
he shall be entitled either to receive from the Borough a lump sum
payment equal to 50% of the total value of his accumulated unused
sick leave, said value being calculated at the administrative officer's
regular rate of pay at the time of his retirement or to take compensatory
time equal to 50% of the total value of his accumulated unused sick
leave, with each accumulated day of unused sick leave equal to eight
hours (subject to the requirements of the Fair Labor Standards Act
and the regulations adopted thereunder). The employee shall be required
to give to the Borough Clerk (and to the Chief of Police in the case
of retirement of the Lieutenant) written notification of the option
said administrative officer has selected and the date of retirement
not later than January 1 of the year preceding the year of retirement.
(3) In the event that records are unavailable to ascertain
whether either administrative officer has reached the one-hundred-forty-five-day
maximum of accumulated sick days, for each year that records are unavailable
said administrative officer shall be credited with the annual average
number of sick days accumulated by said administrative officer for
the period during which records are available.
L. Mode of compensation. The administrative officers
shall be paid the total of all compensation for each year biweekly,
in equal amounts, except those amounts which are specifically designated
as lump sum payments.
M. Liability provisions. Whenever an administrative officer
is a defendant in any action or legal proceeding arising out of any
action directly related to the lawful exercise of police powers in
furtherance of his official duties, the Borough shall provide said
administrative officer with necessary means for the defense of such
action in accordance with the provisions of N.J.S.A. 40A:14-55.
N. General and miscellaneous.
(1) The Chief of Police will be permitted to attend the
annual New Jersey State Chiefs of Police Training Conference without
loss in pay in accordance with N.J.S.A. 40A:14-177. The Borough will
reimburse the Chief for reasonable lodging and meal expenses, provided
that there is adequate provision in the Police Department budget for
such expenses.
(2) The Borough will pay for dues for bona fide law enforcement
organizations for the administrative officers, provided that there
is adequate provision in the Police Department budget for such expense.
The Chief of Police shall be responsible for
fulfilling all responsibilities, functions and obligations as set
forth pursuant to statute, Borough ordinance and the Borough of Kinnelon
Police Department's rules and regulations, as from time to time amended,
where such rules and regulations are applicable to his position.

The Lieutenant shall be responsible for fulfilling
all responsibilities, functions and obligations as set forth in the
Borough of Kinnelon Police Department's rules and regulations, as
from time to time amended, where such rules and regulations are applicable
to his position.
