A. 
The purpose of this article is to authorize off-duty police-related employment of Kinnelon police officers and establish a formal policy regarding the use of said officers during off-duty police-related employment.
B. 
Members of the Police Department shall be permitted to accept police-related employment for private persons or entities (employers) only during off-duty hours and at such times as shall not interfere with the efficient performance of their regularly scheduled duty or emergency duty for the Borough.
C. 
Any employer wishing to employ off-duty police officers shall first obtain the approval of the Chief of Police, which approval shall be granted only if such employment shall not be inconsistent with the efficient functioning and good reputation of the Borough Police Department, and shall not endanger or threaten the safety of the officer or officers who are to perform the work.
D. 
No off-duty work shift of an individual police officer shall be less than two hours or more than specified in the request for services.
A. 
Any employer requesting the services of an off-duty police officer in the Kinnelon Police Department shall estimate the number of hours such police-related activities shall require, which estimate shall be approved in writing by the Chief of Police, and shall establish an escrow account with the Borough Treasurer by depositing an amount sufficient to cover the rates of compensation and administrative fees set forth in § 56-52 of this article for the total estimated hours of service.
B. 
Prior to the posting of any request for services of an off-duty police officer, the Chief of Police or his designee shall verify that the balance of the escrow account of the employer requesting such services is sufficient to cover compensation and fees for the number of hours specified in the request for services. The Chief of Police shall not post a request for services from any employer unless all fees and compensation required in the manner described above have been deposited with the Borough Treasurer. No police officer shall provide any such services for more hours than are specified in the request for services or for less than two hours of service.
C. 
In the event that the funds in such an escrow account should become depleted, services of off-duty police officers shall cease, and requests for further or future services shall not be performed or posted until additional funds have been deposited in the escrow account in the manner described above.
D. 
The employer requesting such services shall be responsible for ensuring that sufficient funds remain in the escrow account in order to avoid any interruption of services.
All requests to the Borough for the services of off-duty police officers in the Kinnelon Police Department for a period of one week or longer shall be forwarded to the Chief of Police for posting of at least 10 days before such services are required. Any police officers, when so employed by the Borough, shall be treated as an employee of the Borough; provided, however, that wages earned for outside employment shall not be applied toward the pension benefits of police officers so employed, nor shall hours worked for outside employment be considered in any way compensable as overtime.
A. 
The rate of compensation for contracting the services of off-duty police officers shall be based upon a rate of individual overtime plus benefits and other incidental costs in effect for each individual officer.
B. 
An additional fee of $2 per hour is hereby established to cover administrative costs, overhead and out-of-pocket expenses of the Borough of Kinnelon.
C. 
An additional fee of $10 per hour is hereby established for the use of a Borough police vehicle to cover administrative costs, overhead and out-of-pocket expenses of the Borough of Kinnelon.
