Every person riding a bicycle upon a roadway shall be granted all the rights and duties applicable to the driver of a vehicle by Chapter 4 of Title 39 of the Revised Statutes and all supplements thereto, except as to those provisions thereof which by their nature can have no application.
Every person operating a bicycle upon a roadway shall
ride as near to the right side of the road as practicable, exercising
due care when passing a standing vehicle or one proceeding in the
same direction.
A person propelling or riding on a bicycle shall not
ride other than upon or astride a permanent and regular seat attached
thereto, nor shall he ride with his feet removed from the pedals or
with both hands removed from the handlebars, nor shall he practice
any trick or fancy riding in a street. No bicycle shall be used to
carry more persons at one time than the number for which it is designed
and equipped.
No person riding upon any bicycle, coaster, skates,
sled or toy vehicle shall attach the same or himself to any vehicle
upon a roadway, and no operator of any vehicle shall knowingly allow
any person riding upon any of the above to attach the same or himself
to the vehicle.
Every bicycle when in use at nighttime shall be equipped
with a lamp on the front which shall emit a white light visible from
a distance of at least 500 feet to the front, and a red reflector
on the rear of a type which shall be visible at all distances from
50 feet to 300 feet to the rear when directly in front of lawful upper
beams of headlamps on a motor vehicle. A lamp emitting a red light
visible from a distance of 500 feet to the rear may be in addition
to the red reflector.
No person shall operate a bicycle unless it is equipped
with a bell or other device capable of giving a signal audible for
a distance of at least 100 feet, except that a bicycle shall not be
equipped with, nor shall any person use upon a bicycle, any siren
or whistle.
No person shall operate a bicycle which, in the opinion
of an inspecting police officer, has been deemed to be unsafe to operate
because of physical or mechanical deficiencies.
Every person who violates this chapter may be summoned
to appear before the Chief of Police, or a committee appointed by
him, for a hearing, at which time the offender shall be entitled to
be represented by counsel. At said hearing, evidence shall be produced
by the officer making the complaint, and the offender shall be entitled
to produce evidence in his behalf. Upon being found guilty, the bicycle
of the offending owner may be impounded or padlocked at the home of
the owner for such period as the Chief of Police in his discretion
may direct.
The powers and duties hereinabove conferred upon the
Chief of Police may be delegated by him in particular cases to any
member of the Police Department.
The basic intention of this chapter is not the prosecution
of children, but rather their education and training in the use of
bicycles for their own and the Borough's welfare. Continued and willful
refusal to comply with the regulations imposed herein may subject
the offender to prosecution before the proper juvenile authorities.
