There is hereby authorized adoption and entry
into the pension plan known as the "Borough of Longport pension plan
for lifeguards" (hereinafter, "the plan"), with an effective date of January 1, 1987, by and between
the Borough of Longport and those eligible members of the Longport
Beach Patrol. Said plan was amended 10-7-1987 by Ord. No. 11-87 and
amended by Ord. No. 2022-14 to change the definition of "A Year of
Service" as noted in the plan on file.
Entry into the aforementioned plan is pursuant
to N.J.S.A. 43:13-23 et seq., as it has been interpreted by the New
Jersey Superior Court. In the event that the Legislature or courts
determine to alter, amend, revoke or interpret such law in any other
manner, then the Borough of Longport reserves the right to similarly
alter, amend, revoke or interpret the plan. Establishment of the plan
in the fashion as it exists on the date of adoption of this article
creates no vested future right as to any unearned benefit, provision,
protection or procedure set forth in the plan at its inception. Pension
Commissioners appointed pursuant to the plan acquire no tenure or
vested rights in their positions and serve at the pleasure of the
governing body of the Borough of Longport.
This article shall be a part of the plan, and
any interpretation, construction or reference to the plan shall similarly
make reference to this article.

The Beach Patrol of the Borough shall consist of the following:
Chief of the Beach Patrol, lieutenant(s), lifeguards, beach tag inspectors,
and such other and additional personnel as may be authorized by the
governing body.
The Beach Patrol shall operate as a division within the Department
of Public Safety.
The Director of Public Safety is the chief administrative officer
of the Beach Patrol. The Chief of the Beach Patrol is under the authority
of the Director of Public Safety and Borough Administrator. The Chief
is tasked with the daily administration of the Beach Patrol.
All lifeguards as well as superior officers shall be issued
appropriate uniforms and equipment sufficient to permit the performance
of their duties as determined by the Borough in consultation with
the Chief.
