As used in this chapter, the following terms
shall have the meanings indicated:
CHARTER AUTOBUSES
A bus or buses or other vehicle or vehicles propelled by
motor power operated by the person owning or leasing such bus or buses
or other vehicle or vehicles propelled by motor power pursuant to
a contract, agreement or arrangement to furnish an autobus or autobuses
or other vehicle or vehicles propelled by motor power and a driver
or drivers thereof to a person, group of persons or organization (corporate
or otherwise) for a trip designated by such person, group of persons
or organization for a fixed charge per trip, per autobus, per vehicle
or per mile, or operated by the person owning or leasing such bus
or buses or other vehicle or vehicles propelled by motor power for
the purpose of carrying passengers for hire, each passenger paying
a fixed charge for his carriage, on a special trip arranged and designated
by such owner or lessee.
PERSON
Persons, firms, associations, copartnerships and corporations,
and the employees, agents and servants of such persons, firms, associations,
copartnerships and the officers, employees, agents and servants of
such corporations.

Nothing herein contained shall be construed
to include:
B. Buses employed solely in transporting school children
and schoolteachers to and from schools in said Borough;
C. Autobuses operated wholly within the Borough limits
by virtue of a franchise from said Borough;
D. Autobuses which operate within the Borough under municipal
consent; over a regularly established route either intrastate or interstate
between fixed termini upon a regularly established and published schedule;
E. Autobuses or other conveyances operated for the purposes
of transporting residential guests to and from their vehicles which
are parked away from the location of the event to which they are invited,
provided that the Chief of Police of the Borough of Longport is given
prior notice with the time and location of the guest transportation
service, the type of vehicle to be used, proof of adequate insurance
and licensing, and other pertinent information required by the Chief
of Police whereupon permission shall be granted if the limited purpose
requirements of this exclusion are duly met.
It shall be unlawful for any person to park
any charter autobus as herein defined on or over any street, avenue,
boulevard, public place or portions thereof located and lying within
the Borough limits of Longport, New Jersey, or to discharge or receive
passengers at any place or places within said Borough, except as hereinafter
provided in this chapter.
This chapter is hereby declared to be necessary
in the interest of public safety, the public welfare and the public
health of the community in order to relieve congestion of traffic
and to obtain funds to regulate charter autobuses and to lessen the
fire hazard.
No charter autobus, as hereinbefore defined,
shall be operated on any street within the Borough of Longport except
Ventnor Avenue and Atlantic Avenue nor discharge or pick up its passengers
at any place other than the place designated in the permit hereinafter
provided.
Any charter autobus to be operated within the
limits of the Borough of Longport and discharge or pick up its passengers
within said Borough limits must first obtain a permit from the Chief
of Police of the Borough of Longport or his representative, for which
a fee of $25 shall be paid to the Borough prior to the issuance of
said permit for each charter bus entering the Borough. The application
for a permit must be made in writing by the owner or operator of said
charter autobus, and said application must contain the following information:
the name and address of the owner of said charter autobus; the number
of passengers to be transported on said charter autobus; the number
of passengers under the age of 18 years of age; the date of arrival
and departure; and the approximate time of day of arrival and departure.
Said application must be filed by the owner or operator and must be
accompanied by the fee of $25 for said permit.

No charter autobus may enter the Borough of
Longport for the purpose of discharging or picking up passengers after
10:00 p.m. or before 7:00 a.m. The Chief of Police may, in his sole
discretion, grant an exception to these times upon request.
All permits as herewith set forth in § 72-6
must be issued by the Chief of Police or his representative five full
days prior to the date the charter autobus intends to arrive in the
Borough of Longport. Said permit shall designate a place for said
charter autobus to pick up and discharge passengers.
This chapter shall be in effect between May
15 and September 15 of each year.
Any person violating any of the provisions of
this chapter shall, upon conviction thereof before the Municipal Court
Judge of the Borough of Longport, be sentenced to pay a fine not exceeding
$500 or to imprisonment for not more than 90 days in the county jail,
or both, in the discretion of said Municipal Court Judge.
