As used in this chapter, the following terms
shall have the meanings indicated:
AVERAGE FAMILY USE
The average usage of water for that particular property by
the family during the same reading period during the three previous
years prior to the defect. If the defect and/or replacement occurs
prior to the municipality being able to determine a three-year prior
usage during that same reading period, the municipality shall be authorized
to estimate the usage by using a property of similar location and
size, as determined by the Borough, in order to estimate said usage.
PER-UNIT FORMULA FOR COMMERCIAL WATER METERS
The average use by said property during the same reading
period three years prior to the inability of the municipality to take
said reading. If an average is not able to be determined, then the
municipality is authorized to take a property of similar size and
usage and apply the reading period in question of that property as
an estimate.
If said water meters for any reason whatsoever
need repair and/or replacement, the responsibility of said repair
and/or all replacement shall be hereinafter affixed to the municipality.
The Borough of Longport shall determine the
need for repair or replacement as may be determined through routine
inspection of the property. The property owner shall receive notice
that repair or replacement is necessary as it may affect the daily
operations of the owner. The cost for repair or replacement shall
be borne by the municipality.
If, as a result of the defect in the water meter,
the Borough of Longport is unable to take an accurate reading as to
the usage of water for that particular property for any designated
water meter reading period, then the Borough of Longport is hereinafter
authorized to estimate the water usage for that particular property
by applying the formula of average family use as to residential meters
and a formula of minimum per-unit allocation as to commercial usage.
Should any water meter within the Borough of
Longport, whether residential or commercial, be damaged in any way
intentionally by any person, the Borough of Longport is hereinafter
authorized to estimate the water usage for that particular property
by applying the formula of average family use as to residential meters
and a formula of minimum per-unit allocation as to commercial usage.
