As used in this chapter, the following terms shall have the meanings indicated:
COMMISSIONER
The member of the Council of the Borough of Maywood assigned by the Mayor and Council to be the Council's representative to the Squad.
LINE OFFICERS
The Captain. First Lieutenant and Second Lieutenant of the Squad.
SQUAD
The First Aid and Emergency Squad of the Borough of Maywood.
The First Aid and Emergency Squad of the Borough of Maywood, as heretofore established, is hereby continued.
The Squad shall, in emergencies and when called upon, render ambulance and first aid service in accordance with this chapter and with all applicable federal and state statutes, rules and regulations and in accordance with all bylaws, rules and regulations established hereunder.
A. 
The Squad shall consist of not more than 40 active members, 10 of which will be reserved for those members who return to active service from student/military leave. The Squad may also include such number of additional inactive members as may be determined in the Squad's bylaws.
B. 
As a condition for membership and continued membership in the Squad, each member shall:
(1) 
Be a resident of the Borough of Maywood or a nonresident of the Borough of Maywood who is employed in the Borough of Maywood and during such period of time as such person is so employed, provided that such person has a letter of permission from such person's employer to leave such employment for the purpose of making ambulance calls and provided that such person shall hold a valid certification, as hereinafter provided for. A person may qualify as a nonresident member if he or she maintains his or her primary residence within a two-mile radius of the borders of the Borough of Maywood.

(2) 
Be at least 18 years of age.
(3) 
Be in good physical condition and be capable of carrying safely, with another Squad member, an adult weighing 175 pounds in a confined stairwell on a piece of equipment normally used by the Squad in the performance of its duties.
(4) 
Be able to speak and understand the English language.
(5) 
Hold a current valid New Jersey driver's license.
(6) 
Be the possessor of such emergency care certifications as are mandated by the New Jersey State First Aid Council.

C. 
All appointments to and terminations from the Squad shall be submitted to the Mayor and Council for its review and approval.
An applicant for membership in the Squad shall:
A. 
Satisfy all qualifications for membership as set out in § 28-4 of this chapter.[1]

B. 
Present a certificate of a licensed physician certifying the applicant to be in good physical condition capable of performing the duties of a Squad member.

The officers of the Squad shall consist of a Captain, who shall have been a member of the Squad for at least three years before becoming eligible to take office as Captain, a First Lieutenant, a Second Lieutenant, a President, a Vice President, a Secretary and a Treasurer, all of whom shall be active members of the Squad at the time of their election and throughout the period during which they shall hold such office.
A. 
The election of the officers of the Squad shall take place at the November meeting of the Squad, by closed ballot, with no proxy voting permitted, and election to any office shall be by a majority of the votes cast for that office.
B. 
The officers so elected shall enter upon the duties of their offices on the first day of January following their election and shall serve for a period of one year and until their successors are elected and qualified.
C. 
Officers may be elected to succeed themselves; provided, however, that after an officer shall have served three consecutive full terms in one office, such officer shall not be eligible to serve again in that office until 12 months have passed during which he shall not have held that office; provided further, however, that this limitation shall not apply to the office of Secretary or Treasurer.

D. 
In the event of a vacancy in any office, the unexpired term shall be filled at the next regular meeting of the Squad, and each member of the Squad shall receive written notification at least 48 hours in advance, advising of the vacancy and stating that the same shall be filled by election at such meeting. Elections to fill vacancies shall be by ballot in the manner described above respecting the election of officers at the annual election.
A. 
Subject to the direction of the Mayor and Council, the Captain shall be in charge of the actual operation of the Squad, including its equipment and building, and shall be responsible for the good order of such equipment and building. He shall conduct drill meetings; prepare and post all duty rosters; inspect annually the driver's license and current Emergency Care Certifications as mandated by the New Jersey State First Aid Council; report monthly to the Mayor and Council, through the Squad's liaison to the Mayor and Council, respecting the condition of all apparatus and equipment of the Squad, the activities of the Squad and the Youth Squad and the status of its membership; and shall provide such other information concerning the Squad as may be requested from time to time by the liaison to the Mayor and Council or the Mayor and Council.

B. 
The First Lieutenant shall assist the Captain and, in his absence, shall perform all of his duties.
C. 
Second Lieutenant shall assist the Captain and First Lieutenant and, in the absence of the First Lieutenant, shall perform all of his duties.
D. 
The President shall be the chief administrative officer of the Squad and shall preside at all of its meetings.
E. 
The Vice President shall perform the duties of the President in his absence.
F. 
The Secretary shall maintain the records of the Squad, including all meetings of the Squad, and furnish required notices of the meetings of the Squad.
G. 
The Treasurer shall be the custodian of the funds of the Squad and shall maintain accurate record of the condition of such funds, including receipts and disbursements.
H. 
In addition to the foregoing, the officers shall have such additional powers and duties as may be set out in the bylaws of the Squad.
A. 
The apparatus and equipment of the Squad shall be used only for the purposes for which the Squad is established, including training purposes, and also including participation in parades and official ceremonies when authorized by the Mayor and Council or by the Commissioner.
B. 
The members of the Squad shall be responsible for the care and operation of the apparatus and equipment and shall observe all Squad rules and regulations regarding such operation and care.
C. 
No member of the Squad shall tamper with the apparatus or equipment or fix or repair the same unless so authorized by the Captain or, in his absence, the First Lieutenant or, in the absence of both the Captain and the First Lieutenant, the Second Lieutenant.
D. 
The acquisition of any apparatus or equipment, the making of any purchase or the entering into of any contract, the cost or contract price of which, in whole or in part, is to be paid with or out of public funds, shall be acquired, made or entered into only in accordance with applicable law and the borough's standard purchasing procedures.
A. 
The Squad is hereby authorized and empowered to adopt, amend and supplement bylaws, rules and regulations which shall provide for the administration and operation of the Squad and prescribe the duties and rules of conduct of the members thereof and shall contain such other matters as are necessary or useful for the proper functioning of the Squad. Said bylaws, rules and regulations shall not become effective until first presented to and approved by the Mayor and Council.
B. 
Said bylaws, rules and regulations and any amendments or supplements thereto may be adopted by a two-thirds vote of the membership present and voting at a meeting of the membership of the Squad. Notice of such proposed bylaws, rules and regulations and amendments and supplements thereto shall be given by mail to each member at least seven days prior to the date of such meeting.
A. 
Failure to obey a lawful order of a line officer; insubordination to a line officer; negligent or willfully improper conduct in the performance of duty, including practice drills, training sessions, inspections, emergency calls or other Squad duties; and violation of the provisions of this chapter or any other applicable ordinance or statute or any applicable rule or regulation adopted thereunder or of the bylaws or rules and regulations of the Squad shall constitute grounds for suspension or expulsion of a member of the Squad.
B. 
If the Captain or any other line officer has reason to believe that there are grounds for the expulsion or suspension of any Squad member for any of the reasons set out in Subsection A above, he shall prepare a written statement of the charges against such member. If such charges are made by a line officer other than the Captain, they shall, promptly after such written statement is prepared, be delivered to the Captain.
C. 
The Captain shall fix a date, time and place when such charges shall be heard by the membership of the Squad and shall cause to be served upon the Squad member so charged a written copy of the charges against him, together with a written notice of the date, time and place when such charges shall be heard by the membership of the Squad, provided that such hearing shall be held not less than 10 days after the written charges and the written notice of hearing are served upon the Squad member whose conduct is the subject of such charges. The Captain shall also cause notice of such hearing to be given to each Squad member not less than five days prior to the date fixed therefor. A copy of the notice of charges and notice of hearing shall also be provided to the Mayor and Council by service upon the Borough Clerk not less than five days prior to the date fixed for the hearing.
D. 
At the hearing to be held before the Squad membership, the Captain or the other line officer who has made the charges shall present the grounds therefor and the reaons why such charges were made and any facts and information, including testimony by anyone having knowledge which relates to the charges, which he believes substantiates the charges. Any Squad member shall have the right to present any information or facts which may relate thereto. The Squad member who is charged with misconduct shall have the right to be heard with respect to such charge and to present such information or facts as he believes relate to the charges or his defense thereto, including the testimony of persons having knowledge or information which relates thereto. The Squad member who is charged shall also have the right to appear with an attorney, provided that any cost thereof shall be at such Squad member's sole cost and expense.
E. 
At the conclusion of the hearing, the Squad members present shall vote to determine guilt or innocence of the charges presented and, if guilty, whether the member found guilty should be expelled from membership or suspended and, if suspended, the duration of such suspension. Any finding of guilty and the imposition of any penalty shall require a two-thirds vote of those squad members present and voting. The result of the hearing shall, promptly thereafter, be reported to the Mayor and Council by the Captain.
F. 
The Captain shall have the right to suspend any member of the Squad for any of the reasons set out in Subsection A if the Captain determines that there are reasonable grounds to believe that the member has committed one or more of the acts described in Subsection A and if he determines that the charges are sufficiently serious to require immediate action, provided that the Captain shall first give the member an opportunity to be heard. Following such suspension, the Captain shall forthwith prepare a written charge, which shall be forthwith served upon the member, and, if the member suspended so demands, then, notwithstanding the notice provisions of Subsection C, trial of such charges shall be held within five days from the date of such suspension, and the Captain shall give at least three days' written notice thereof to all Squad members and to the Mayor and Council.
G. 
If any member shall be expelled or suspended from the Squad, such member may appeal such removal or suspension to the Mayor and Council. Such appeal shall be made by giving notice thereof to the Secretary of the Squad and to the Borough Clerk within 10 days after notice of such expulsion or suspension is given to such member. The Mayor and Council shall hear the matter de novo and may affirm such expulsion or suspension if it finds the member guilty, or, if it finds the member guilty but believes the penalty imposed to be unduly severe, it may reduce such penalty, or, if it finds the member not guilty, it shall forthwith reinstate him as an active member of the Squad.
A. 
Any member who, by reason of injury or illness, shall become temporarily unable to perform the duties required of a Squad member shall be placed on inactive status. If, after a period of six months on inactive status, the member shall remain unable to perform the duties of a Squad member, such inability shall be deemed permanent, and the member shall be retired from the Squad as a life member; provided, however, that if it shall be established to the satisfaction of the Mayor and Council that such disability is not permanent, such inactive status may be continued for an additional period of time as determined by the Mayor and Council.
B. 
If at any time, by reason of accident or illness or otherwise, the Captain, in his judgment, believes that there exists a question as to whether a member is able to perform the duties of a Squad member, the Captain may instruct such member to obtain a physical examination by the Borough Physician for the purpose of determining the member's ability to fulfill the duties of a Squad member. If the report of such examination shall show the member's inability to perform the duties of a Squad member, such member shall be placed on inactive status as provided in Subsection A above.
C. 
A Squad member who contests a finding that he or she is unable to perform the duties of a Squad member by reason of disability may appeal such decision to the Mayor and Council in the manner provided in § 28-11.
A. 
If, at any time, the Captain determines that any Squad member shall have failed or ceased to comply with the conditions for membership in the Squad, as set forth in § 28-4B hereof or in any other applicable ordinance, statute, rule or regulation, he shall so advise such Squad member and follow the steps set forth by the New Jersey State First Aid Council to correct such failure or to remedy such condition. In the event that such failure is not corrected or such condition is not remedied, the Captain shall suspend such member from active service until the person suspended shall have complied with the conditions or recommendations set forth and if not so accomplished within a twelve-month period from the date of such suspension, such member shall be retired from membership with full rights and privileges, including life membership, if applicable, provided that such Squad member shall have a right to demand a hearing before the members of the Squad on such decision made by the Captain, and, in such event, a hearing shall be held in the manner and pursuant to the provisions of § 28-11 hereof, provided further, that a vote of 2/3 of the Squad members present and voting shall be necessary for the suspension or retirement of any member, and any such action shall be subject to appeal to the Mayor and Council, as provided in § 28-11.

B. 
It shall be the responsibility of the Captain to determine that all Squad members comply with all applicable requirements of federal and state law and applicable requirements of the New Jersey State First Aid Council enacted pursuant to federal or state law, with respect to training qualifications and certifications of Squad members, and any Squad member who shall not have complied with any such training, qualification or certification requirement shall not be permitted to engage in any activity of the Squad for which such training, qualification or certification shall be required. The filing with the Mayor and Council or with any other agency of all required certifications relative to the training and qualifications of Squad members shall be the responsibility of the Captain.
A. 
Establishment and qualifications for membership.
(1) 
There is hereby created and established in and for the Borough of Maywood a Youth Squad for the First Aid and Emergency Squad of the Borough of Maywood.
(2) 
The Youth Squad shall be open to all persons 16 years and older, each of whom shall be a resident of the Borough of Maywood, in good health, as shall be so certified by a physician licensed to practice in the State of New Jersey.

(3) 
Each applicant for Youth Squad membership who has not attained the age of 18 years shall have the written permission therefor of his parent or guardian, and such written permission shall be in such form as shall be approved by the Captain of the First Aid and Emergency Squad of the Borough of Maywood, and which written permission shall be kept as part of the permanent record of the First Aid and Emergency Squad by the Secretary thereof.
(4) 
Members of the Youth Squad shall be insured with the same coverage and in the same amounts provided for the regular members of the First Aid and Emergency Squad of the Borough of Maywood.
B. 
Rules and regulations. The rules and regulations of the First Aid and Emergency Squad of the Borough of Maywood shall be the rules and regulations to govern the activities of the Youth Squad, consistent with and in conformance with the following:
(1) 
No Youth Squad member shall be required to perform the same actual emergency duties as a regular member of the First Aid and Emergency Squad.
(2) 
The Captain of the Maywood First Aid and Emergency Squad shall provide for an educational program for first aid and emergency services designed to train the members of the Youth Squad in the providing of first aid and emergency services as authorized by this chapter and the laws of the State of New Jersey. Such training shall be with a view toward qualifying such Youth Squad members as qualified and certified members of the regular First Aid and Emergency Squad of the Borough of Maywood.
(3) 
The Captain of First Aid and Emergency Squad may direct advisers and training officers to assist him in the training of the Youth Squad members.
(4) 
The Captain of the First Aid and Emergency Squad shall file annual reports with the governing body concerning the membership, training and status of the Youth Squad members, which reports shall be filed during the month of January in each year.
(5) 
Members of the Youth Squad may attend emergency services performed by the First Aid and Emergency Squad, provided that they shall have completed their training and have been approved by the Captain. Youth Squad members may, at the direction of and in the presence of a regular Squad member, assist in equipment maintenance and inventory and may participate in training exercises scheduled for the members of the regular First Aid and Emergency Squad, in the sole discretion of the Captain thereof. No Youth Squad member shall administer first aid and emergency service to any person in the name of or under the auspices of the First Aid and Emergency Squad of the Borough of Maywood unless authorized by an officer or senior member present.
(6) 
The Captain of the First Aid and Emergency Squad of the Borough of Maywood may apply for appropriations for equipment and training on behalf of the Youth Squad. Any equipment purchased for such Youth Squad shall be logged and inventoried in a separate ledger maintained by the First Aid and Emergency Squad for such purpose. In no event shall equipment for Youth Squad members be released from the possession and control of the First Aid and Emergency Squad without the prior written consent of the Captain or his designated representative.
(7) 
No member under the age of 18 shall operate any power-assisted mechanical equipment of the Maywood First Aid and Emergency Squad.
C. 
Limitations of membership. The Youth Squad shall be limited to not more than 20 members.
D. 
Discipline of members.
(1) 
All Youth Squad members shall be subject to disciplinary action by the Captain of the First Aid and Emergency Squad of the Borough of Maywood, and all disciplinary action taken against a member by said Captain shall be final and in the Captain's sole discretion, subject to appeal to the Mayor and Council as provided in § 28-11.
(2) 
Infractions.
(a) 
Apart from rules and regulations which may be established by the Captain of the First Aid and Emergency Squad, Youth Squad members who violate any of the following restrictions shall be subject to immediate disciplinary action by the Captain:
[1] 
Violation of any provision of this chapter.
[2] 
Failure to obey an order or direction of a regular First Aid and Emergency Squad member in the line of duty.
[3] 
Insubordination to any regular member of the First Aid and Emergency Squad in the line of duty.
[4] 
Failure to attend mandatory training sessions unless specifically excused by the Captain of the First Aid and Emergency Squad.
[5] 
The commission of any act or series of acts which tends or may tend to discredit the Youth Squad or the regular First Aid and Emergency Squad.
[6] 
Violation of any rule or regulation established by the Captain for the Youth Squad or by the First Aid and Emergency Squad for the conduct of its regular members.
(b) 
Disciplinary action by the Captain may include suspension of the Youth Squad member for a period of not more than 21 days or expulsion, in the sole discretion of the Captain, subject to appeal to the Mayor and Council as provided in § 28-11.
E. 
The Youth Squad may, if approved by the Captain of the First Aid and Emergency Squad and the Mayor and Council, adopt a Constitution and bylaws relating to the conduct of the affairs of such Youth Squad and, subject to approval, elect a Captain, a Lieutenant, a Secretary and a Treasurer.

A. 
There is hereby established a paid Emergency Medical Service (EMS) for the Borough of Maywood, consisting of such number of paid emergency medical technicians (EMTs) as may be authorized under the current salary ordinance.
B. 
The following standard operating procedure is hereby established for the EMS in accordance with the requirements of N.J.A.C. 8:40-1.1 et seq., the provisions of which are hereby incorporated herein and are made part of the standard operating procedure:
(1) 
Nondiscrimination
(a) 
The EMS shall give service to all regardless of their race, sex, creed, skin color, national origin, age, disability or medical condition of the patient. This includes patients with any communicable diseases such as AIDS, TB or hepatitis.
(b) 
The EMS shall not fail to respond to an emergency call, refuse to give emergency treatment to or transport any person because of that person's ability to pay for the service.
(2) 
Special requirements for emergency response.
(a) 
To do emergency response or to bid on a contract for emergency response, the EMS shall be a licensed ambulance provider.
(b) 
There shall be a semiautomatic defibrillator in the EMS vehicle at all times.
(c) 
The EMS shall have a quality control system in place to continuously monitor the quality of care. This shall include dispatching of vehicles, safe driving, documentation of care on the patient care report form, quality of the medical care provided, appropriate use of advanced life support services and the triage of patients. The quality control system shall include feedback on the quality of care which the EMS is providing.
(d) 
The EMS shall notify the New Jersey Department of Health and Senior Services, Office of Emergency Medical Services (OEMS) at least seven days before emergency response services begin or before the starting date of a contract with a municipality.
(e) 
The EMS shall give written notification to OEMS at least 60 days before the EMS plans to discontinue emergency response services or before the closing date of a contract with a municipality.
(f) 
The EMS shall have a minimum of two licensed emergency ambulances that have been completely upgraded to meet emergency response requirements. One shall be the primary vehicle and one a backup that is immediately available for use when the primary emergency response vehicle breaks down or needs regular maintenance.
(3) 
Surveys and licensure.
(a) 
The EMS shall allow authorized OEMS staff to conduct inspections to make sure the EMS is in compliance with all of the regulations.
(b) 
Inspections may be made at any time and at any location used by the EMS, at any place of medical care and wherever a patient is picked up or dropped off. OEMS staff cannot stop an EMS vehicle while it is traveling on a public road.
(c) 
These inspections can include a review of all required records and forms, conferences with staff and patients and an inspection of the EMS's business locations, vehicles, equipment, proof of training and driver's license.
(4) 
Imminent threat.
(a) 
OEMS staff may order a vehicle "out of service" if it find that the vehicle, equipment or improper staffing poses an imminent threat to the health, safety or welfare for the public, patients or staff.
(b) 
Imminent threat may include, but is not limited to, problems with the brakes, tires, exhaust systems, door locks and handles, oxygen or storage of equipment. It also includes serious patient care violations such as missing (or broken) oxygen or suction equipment.
(c) 
If a vehicle is ordered out of service, the EMS shall immediately stop using the vehicle to transport patients. The vehicle shall remain out of service until it passes a reinspection by OEMS staff. Only OEMS staff can remove an out of service sticker from a vehicle.
(5) 
License renewal. To continue to operate, EMS shall renew its license every two years. The EMS shall apply as required and continue to comply with the regulations. The OEMS staff will conduct unannounced spot checks and periodic inspections of EMS vehicles and operations.
(6) 
Penalties. The EMS can have its license suspended and/or revoked for violations of the regulations.
(7) 
Unusual occurrences.
(a) 
The EMS shall call the OEMS office immediately to report the incident to the Supervisor of Ambulance Licensing. The EMS shall follow up with a letter and official OEMS Accident/Incident Report form within 14 days. The reportable incidents include but are not limited to:
[1] 
Any death or injury requiring hospitalization or treatment in an emergency department which occurred to a patient while in the EMS's care or while being transported in one of its vehicles.
[2] 
Any death or injury requiring hospitalization or treatment in an emergency department which occurred to any of the EMS's staff while on duty.
[3] 
Any motor vehicle accident which occurred to one of the EMS's vehicles while on a public roadway which resulted in the death, hospitalization or treatment in an emergency department of any person.
[4] 
Any fire within an EMS vehicle or office resulting in damage to the EMS's records.
[5] 
Any removal of an EMS vehicle from service for a period of more than 30 days.
[6] 
Any instance where a crew member acts outside of his or her approved scope of practice.
[7] 
Any and all incidents or series of incidents which, upon objective evaluation, lead to the good-faith belief that the conduct is in violation of any applicable law, rule and/or regulation, including, but not limited to, any instances of child abuse or neglect, elder abuse, domestic violence and/or the utilization of physical behavioral restraints.
(b) 
The required followup letter and Accident/Incident Report form shall include any additional information known, such as condition of and prognosis for injured persons, copies of any official reports and the estimate of the degree of disruption of service.
(8) 
Elder or child abuse. The EMS shall take note of any signs of elder or child abuse to the patient that the EMS observes. The EMS shall immediately report it to the medical staff at the medical facility.
(9) 
Uniform. All personnel who staff EMS vehicles shall wear the approved uniform, including:
(a) 
A name badge.
(b) 
A photo ID that OEMS staff may utilize in order to verify the validity of the required credentials.
(c) 
The EMS's name shall be on the uniform.
(d) 
EMS personnel while on duty shall not wear any identification which suggests or indicates affiliation with any other organization or agency.
(e) 
EMS personnel shall only wear patches which indicate the certifications they have obtained.
(10) 
Vehicle operation. No person shall be allowed to staff or operate EMS vehicles while:
(a) 
Under the influence of liquor or habit-forming drugs..
(b) 
Driving in a reckless manner.
(c) 
Driving at excessive speeds.
(d) 
Engaging in any illegal conduct.
(11) 
Training/certification: general requirements.
(a) 
EMS personnel cannot provide patient care beyond the level the EMS is licensed to provide.
(b) 
EMS personnel cannot provide patient care beyond the level of such personnel's own certification.
(c) 
All drivers shall possess a valid New Jersey motor vehicle operator's license.
(d) 
EMS personnel shall carry original training cards and driver's license on their person or with them in the EMS vehicle at all times while on duty.
(e) 
EMS personnel shall present original training certification cards and driver's license to the OEMS as soon as they are issued. The OEMS will make a copy of cards and licenses for its records and return the originals to the EMS. The OEMS requires the EMS to keep this copy in the EMS office for its inspection.
(12) 
Specific required training for ambulance staff.
(a) 
EMS personnel shall have valid, current certification as an emergency medical technician-basic (EMT-B) issued or recognized by the OEMS; and
(b) 
EMS personnel must have valid, current certification for cardiopulmonary resuscitation to the level of the professional rescuer or health-care provider as issued by the American Heart Association, the American Red Cross, the National Safety Council or other entity determined by the OEMS to comply with AHA CPR guidelines.
(13) 
Special ambulance staff required. Should the EMS be requested for a specialty-care transport, the EMS must follow the regulations regarding specialty-care transports found at N.J.A.C. 8:41, Subchapter 10.
(14) 
The EMS staff's collective duties include but are not limited to:
(a) 
Providing prompt effective medical or emergency medical care to patients.
(b) 
Attending the patients at all times and continually monitoring the patient's condition.
(c) 
Extricating the patient from confinement (if necessary).
(d) 
Carrying patients over varying terrain using a variety of patient transport devices.
(e) 
Assisting patients to enter and leave the vehicle.
(f) 
Ensuring the privacy and comfort of patients.
(g) 
Assuring that all patients are safely and properly restrained in the stretcher, wheelchair or other patient transport device.
(h) 
Assuring that any stretcher, wheelchair or other patient transport device is safely and properly restrained in the vehicle.
(i) 
Assuring that all vehicle occupants (other than staff performing CPR) wear automotive seat belts.
(j) 
Operating the vehicle in a safe lawful manner; starting and stopping the vehicle slowing and smoothly.
(k) 
Reporting verbally to and leaving a copy of the call report with the appropriate personnel at the place of medical care.
(l) 
Notifying the medical facility prior to arrival if any special professional services will be needed by a seriously ill or injured patient.
(m) 
Complying with the laws and regulations on the handling of the deceased.
(n) 
Accurately entering data into and signing the call report form.
(o) 
Prohibiting smoking within the vehicle at all times.
(15) 
Sanitation.
(a) 
The inside of all EMS vehicles and all equipment used shall be cleaned every day.
(b) 
After transporting patients known to have AIDS, hepatitis, TB or any other communicable disease, an EMS vehicle shall be temporarily removed from service. Anything touched by the patient or patient's body fluids shall be disinfected as per OSHA standards.
(c) 
The universal precaution of gloves (plus additional protection depending on the specific situation) will be taken for all patient contacts.
(16) 
Physical behavior restraints.
(a) 
EMS personnel cannot put a patient into or transport a patient with physical behavior restraints unless:
[1] 
A physician or court has authorized the placement of the restraints; or
[2] 
The patient is in the custody of a police or corrections officer and the officer accompanies the patient within the patient compartment; or
[3] 
The medical condition of the patient mandates transportation to, and for treatment at, a health-care facility; or
[4] 
The patient shows such a degree of behavior that he or she:
[a] 
Poses serious physical danger to himself or herself or to others; or
[b] 
Causes serious disruption to ongoing medical treatment which is necessary to sustain his or her life or to prevent disability.
(b) 
EMS personnel cannot keep a patient in physical behavior restraints for more than one hour unless:
[1] 
A physician or court has ordered the use of behavior restraints for more than one hour; or
[2] 
The patient is in the custody of a police or corrections officer, and the officer accompanies the patient within the patient compartment of the vehicle.
(c) 
No physical behavior restraints shall be of a type that causes the patient undue physical discomfort, harm or pain. Hard restraints, such as handcuffs, are not to be used unless the patient is in the custody of a police or corrections officer and the officer accompanies the patient within the patient compartment.
(d) 
EMS personnel shall clearly note the reasons for placing and/or transporting a patient in behavior restraints on the call report. A copy of the report shall be given to the appropriate personnel at the medical facility receiving the patient.
(e) 
If behavior restraints are applied after leaving the sending physician or facility, a copy of the call report shall be sent to the physician or hospital within 48 hours.
(f) 
The above-mentioned physical behavior restraints do not apply to automotive safety belts, stretcher patient safety restraints or other safety restraints.
(17) 
Patient's rights. EMS personnel shall:
(a) 
Not leave a patient alone.
(b) 
Not give out any information on the patient's condition or medical status to anyone except the appropriate authorities. OEMS staff, showing the proper ID, have the right to see the patient's medical records.
(c) 
Treat all patients properly and in a most professional manner.
(d) 
Respect the patient's privacy (when changing clothes, etc.)
(18) 
Mobile Intensive Care Unit (MICU) dispatch protocols shall apply to the following:
(a) 
Cardiac problems, e.g., chest pains, pressure, tightness, discomfort accompanied by sweating and fatigue.
(b) 
Respiratory distress, e.g., shortness of breath, including patients turning cyanotic.
(c) 
Unconscious patient, patient not breathing, cardiac arrest.
(d) 
Diabetic emergency.
(e) 
Severe trauma, e.g., serious motor vehicle accidents, entrapment, stabbing, gunshots, serious industrial accidents, pedestrian struck.
(f) 
Allergic reaction.
(g) 
Drug overdose.
(h) 
Stroke.
(i) 
Electrocution/electrical shock.
(j) 
Maternity with imminent delivery.
(k) 
Severe burns.
(l) 
Seizure.
(m) 
Uncontrolled bleeding, including vomiting blood, and profuse rectal or vaginal bleeding.
(n) 
Drowning.
(o) 
Disaster/mass casualty.
(p) 
The MICU may also be dispatched to an emergency at the request of the dispatcher, Police Department or basic life support squad.
(19) 
Vehicle breakdown. If a vehicle breaks down for any cause, EMS personnel shall call the office immediately and another vehicle will be dispatched to pick up the patient. While this is happening, the patient shall not be left alone.

A. 
There is hereby established a third-party payment plan for emergency medical services for the response of ambulance services and the transportation by ambulance to hospitals or other emergency medical facilities by the Borough’s Emergency Medical Service (EMS).
B. 
The fees for such services shall be as set forth in Chapter 169, Fees, of the Code of the Borough of Maywood, as may be amended from time to time.
C. 
The Borough of Maywood shall establish a billing program for such third-party payment plan for emergency medical services provided by the Borough’s Emergency Medical Service (EMS).
