The purpose of this chapter is to establish certain areas on the public streets of the Borough of Maywood where parking shall be prohibited except by persons who are deemed handicapped by the Division of Motor Vehicles of the State of New Jersey.

This chapter is enacted in accordance with the police power granted to municipalities to enact ordinances that are necessary for the health, safety and welfare of the borough granted by statutes that include N.J.S.A. 39:4-197 and N.J.S.A. 39:4-197.5 to 39:4-197.7, which confer upon municipalities the right to establish handicapped parking spaces, and N.J.S.A. 40:48-2.46, which confers upon municipalities the right to regulate parking in parking lots.
The areas hereinafter designated as handicapped parking spaces or areas shall be exclusively for use by persons who have been issued special identification cards by the Division of Motor Vehicles of the State of New Jersey. No other person shall be permitted to park in the designated spaces or areas.
Areas or spaces hereinafter designated as handicapped parking spaces shall be so marked by signs indicating said handicapped parking spaces in conformance with the Manual on Uniform Traffic Control Devices for Streets and Highways. It shall not be a defense to any prosecution for parking in the designated handicapped spaces that the signing or marking of said designated spaces does not comply with the Manual on Uniform Traffic Control Devices for Streets and Highways; provided, however, that the markings or signings so designating the handicapped parking areas shall provide reasonable public notice of the designation of a specific area or parking space as being exclusively for use by handicapped persons.

The following areas are hereby designated as handicapped parking spaces for use by persons who have been issued special identification cards by the Division of Motor Vehicles of the State of New Jersey:
A. 
The vicinity of 43 West Pleasant Avenue: northerly side forty-five-degree angle parking space beginning at a point 31 feet five inches west of the westerly curbline of Oak Avenue and extending to a point 17 feet five inches west thereof.
B. 
The vicinity of 60 West Pleasant Avenue: southerly side forty-five-degree angle parking space beginning at a point 30 feet seven inches east of the easterly curbline of Bergen Avenue and extending to a point 17 feet five inches east thereof.
C. 
The vicinity of 81 West Pleasant Avenue: northerly side forty-five-degree angle parking space beginning at a point 24 feet seven inches east of the easterly curbline of Palmer Avenue and extending to a point 17 feet five inches east thereof.
D. 
The vicinity of 122 West Pleasant Avenue: southerly side forty-five-degree angle parking space beginning at a point 25 feet nine inches west of the westerly curbline of Spencer Joseph Way and extending to a point 17 feet five inches west thereof.
E. 
The vicinity of 34 West Pleasant Avenue: southerly side forty-five-degree angle parking space beginning at a point 35 feet east of the easterly curbline of Oak Avenue and extending to a point 49 feet east thereof.

F. 
The parking lot of the Public Safety Complex, 15 Park Avenue: a forty-five-degree angle parking space located in the southeastern corner of the parking lot.

G. 
In the parking lot of the Municipal Library Building: two 90-degree-angle parking spaces immediately adjacent to the rear entrance.

H. 
In the parking lot for Lydecker Manor: four ninety-degree-angle spaces on the north parking lane adjacent to the west side of the entrance and four ninety-degree-angle spaces in the south parking lane across from the entrance.

In the parking lot for Memorial Park, one ninety-degree-angle space adjacent to the walkway to the park.

In the parking lot for the Maywood Senior Citizen Hall: two ninety-degree-angle parking spaces immediately adjacent to the sidewalk leading to the front entrance.

In the parking lot for Maywood Avenue School: one ninety-degree-angle and two forty-five-degree-angle parking spaces to the north of the rear handicapped accessible entrance.

M. 
In the parking lot for Memorial School: one ninety-degree-angle space adjacent to the entrance on the north side of the building.

N. 
In the Municipal/Commerce Bank parking lot at the corner of Maywood Avenue and Pleasant Avenue, one ninety-degree-angle space in the cut out to the north of the entrance on the west side of the building and one ninety-degree-angle space at the end of the parking lane adjacent to the south side of the building.

Any person who violates any provision of this chapter shall, upon conviction thereof, be punished by a fine of $100 for the first offense and, for subsequent offenses, a fine of at least $100 and up to 90 days' community service on such terms and in such form as the Court shall deem appropriate, or any combination thereof.
