[HISTORY: Adopted by the Mayor and Council of the Borough of Maywood 11-27-1990 as Ord. No. 20-90. Amendments noted where applicable.]
There is hereby created a Local Assistance Board for the Borough of Maywood, New Jersey.
The Local Assistance Board shall be composed of three members, at least one of whom shall be a woman. one of such members may be a member of the Maywood Borough Council. Members serving in such position at the time of passage of this chapter will remain in such position until January 1, 1991, or until such time as their position has been filled. In January of 1991, the Mayor and Council shall appoint one member to such Board for a term of one year and a second member to such Board for a term of two years. Thereafter, appointments to those two positions shall each be for a two-year term. In the event that the Mayor and Council does not appoint one of the Council Members for such one-year term in any year, it may appoint some other person to serve in that capacity, in lieu thereof for such one-year term.
Members of the Local Assistance Board shall serve without compensation but will be allowed necessary and actual expenses.
The term of one member shall be for one year only, and such one-year term must be assigned to a member of the Maywood Borough Council, should a member of the Council be appointed to said Board. The other two members serve terms of two years each, with expiration dates staggered in order to expire at the end of alternate years. The term of each member of the Local Assistance Board shall begin upon his or her appointment by the Mayor and Council in January of each year. When a vacancy occurs before the expiration of the term, the person appointed to serve in such unexpired term shall only serve for the unexpired portion of the term of the person he or she is replacing. When circumstances such as illness or a governmental irregularity preclude timely appointment of a new member, the incumbent shall continue until such new appointee can take office.
Annually, at its first meeting of each year, the Local Assistance Board shall organize and select, from among its membership, a chairman and a secretary. The Director of Welfare shall be the chief administrative officer of the Board.
The Borough of Maywood, whether or not it is applying for state aid, shall submit annually a certification form, Status Report and Request for State Aid for the Calendar Year (Form GA-15), to the DEA/GAP Unit, signed by the Borough Clerk, and attesting to the appointment of the Board members, if any, and the Director of Welfare.
The Director of Welfare shall be appointed for a full term of five years or a temporary term not to exceed 90 days.
A. 
Full-term appointment. A full-term appointment shall be for a period of five years, beginning from the date of such appointment. When a vacancy occurs in such position and a new Director is duly appointed and approved before the expiration of the previous Director's term, the new Director's term of office begins on the date of his or her appointment and continues for five years from such appointment.
B. 
Temporary appointment. In the event of a vacancy in the office of the Director of Welfare, the Mayor and Council may appoint a temporary or acting Director for a term not to exceed 90 days, such temporary appointment not being subject to extension or renewal.
The reappointment of an incumbent Director at the expiration of such Director's current five-year term is solely the responsibility of the Local Assistance Board. Upon decision by the Board to reappoint an incumbent for a full five-year term, the Secretary of the Local Assistance Board will notify the DEA of such decision. After receipt by the Board of DEA approval, formal action of such approval by the Board must be taken at a regular or special Board meeting and duly recorded in the minutes.
A. 
Should the Local Assistance Board decide not to reappoint an incumbent Director or should such incumbent Director decline reappointment, it shall be the responsibility of the Board to promptly select a new full term candidate and to secure approval of such appointment by the DEA. The Local Assistance Board may appoint a temporary Director while a qualified full term candidate is being sought.
B. 
Regardless of the type of appointment made, the Local Assistance Board shall act to assure that the position of Director of Welfare does not remain vacant at any time.
Removal of the Director of Welfare from office must be by official action of the Local Assistance Board and based upon appropriately documented evidence of mismanagement or wrongdoing, at a hearing called for such purpose.
