An absence from any regularly scheduled meeting shall be considered
as an "excused absence" when approved by a majority of the members
of the board, committee or commission. An absence shall be deemed
as excused when that absence occurs as a result of a legitimate illness.
The board, committee or commission may refuse to excuse any other
absence that is not the result of a legitimate illness.
The board, committee or commission shall notify the appointing authority, in writing, when a determination has been made that a member has failed to meet the attendance requirement prescribed in §
26-1. Upon such notification, the office shall be deemed vacant. Such removal shall be effectuated and vacancy shall be filled in the manner(s) prescribed by law.
