No person or group of persons, partnership or corporation shall conduct a carnival (the word "carnival" is defined as any exhibition carried on in the open air or under temporary structures for a short period of time for the purpose of entertainment by games, acts and performances not including, however, exhibitions which are primarily athletic or sports competition) in the Borough of Middlesex without first obtaining from the Mayor and Council of the Borough of Middlesex a license so to do.

A. 
The license fee for conducting such carnival shall be $50 per day.
B. 
Charitable organizations shall be exempt from the payment of a license fee.
Whenever any applicant or applicants shall request the right to hold a carnival the Mayor and Council of the Borough of Middlesex may grant said permit upon condition that not less than two regular or special policemen be stationed on the grounds where the carnival is to be held or along the route where permission for a parade or procession may be given by the aforesaid Mayor and Council, to maintain order, the cost of which, at rates of pay for police established by the Mayor and Council, shall be paid by the applicant or applicants.
The applicant or applicants for a permit to hold a carnival, together with the owner or owners of said carnival, shall, when requested by the Mayor and Council, furnish a proper and sufficient bond to the Borough of Middlesex, in an amount to be fixed by the Mayor and Council, conditioned upon the proper and orderly performance of the carnival and for reimbursement of all damages sustained by the Borough of Middlesex for any misconduct or tort caused by the applicant or applicants.
The issuance of a permit to conduct a carnival by the Mayor and Council shall be further subject to such special conditions that the Mayor and Council may impose to cover special requirements.
In case said carnival shall not run in an orderly and proper manner, the Mayor and Council reserve the right to cancel the permit given therefor and the fees paid shall be retained by said Council.[1]

Any person violating any provision of this chapter shall be subject to penalty of a fine not to exceed $200 or 30 days' imprisonment in the county jail, or both such fine and imprisonment, for each violation to be recovered before the Magistrate of the Borough of Middlesex.
