A. 
The existing program (begun in 1984) governing separation from solid waste of newspapers, corrugated cardboard, glass bottles and jars, aluminum cans, plastic containers, masonry/paving material, asphalt, block, brick, cinder, concrete, brush, leaves, mixed paper, motor oil, steel cans, textiles, rechargeable batteries including, nickel cadmium, nickel metal hydride, lithium ion and small sealed lead, tires, rubber-based scrap automotive, truck and equipment tires, and white goods such as washers, dryers, ranges, refrigerators and air conditioners for recycling is continued. All devices that contain CFCs must be properly evacuated by licensed individuals, and all CFCs recovered must be sent to an EPA-approved reclaimer.
B. 
Business, industrial, commercial, institutional and government establishments are required to continue recycling of the above. In addition: electronics such as televisions, CPUs, monitors, laptops, mercury-containing devices, fluorescent bulbs, lamps that contain mercury, plastic film, stretch/shrink wrap, plastic shopping bags (only for warehouses, retail establishments and supermarkets with 25 or more employees), wood scrap, unfinished lumber from new construction projects, including pallets. "Unfinished" shall mean non-chemically treated (not pressure treated, impregnated with preservatives, insecticides, fungicides, creosote or other chemicals, and not painted, resin-coated or otherwise surface treated, and not laminated or bonded, and not similarly altered from its natural condition), only for new construction sites.
The following shall constitute mandated recyclables in the Borough of Middlesex:
A. 
Newspapers, newsprint and those advertising inserts which come with a daily or Sunday paper, such as comics, colored food and store ads, television and Sunday magazine sections.
B. 
Corrugated cardboard, boxes and packing generally made from wood pulp and consisting of two smooth sides with a corrugated inner layer. Brown paper grocery bags are included.
C. 
Aluminum cans: food and beverage containers made entirely of aluminum.
D. 
Glass containers: bottles and jars in which food and beverages are packaged. The same may be transparent (clear) or translucent and/or tinted brown or green.
E. 
Steel cans: food and beverage cans made of steel and either tin plated or lacquer coated and including bimetal cans (steel cans with aluminum top).
F. 
Plastic containers: soda and other bottles made from PETE (SPI Code No. 1) and milk, water and laundry product bottles made of HDPE (SPI Code No. 2), excluding products containing or that contained household hazardous wastes.
G. 
Mixed paper, glossy inserts, magazines, telephone books, junk mail, colored paper, computer paper, office paper, school paper and fine paper, paperboard (chipboard and pressboard), nonmetallic wrapping paper, softcover books, hardcover books with covers removed and fine paper.
H. 
Textiles: clean, dry clothing or other fabric measuring at least one foot by one foot in size.
I. 
Used motor oil: used lubricating oil from automobile and other engines.
J. 
Brush: branches, woody plants and other like vegetative material not exceeding five inches in diameter and Christmas trees.
K. 
Leaves: means only leaves from trees, shrubs, bushes or plants, and excludes any other type of vegative waste.
L. 
Tires: rubber-based scrap automotive, truck and equipment tires.
M. 
Masonry/paving material: asphalt, block, brick, cinder and concrete.
N. 
Rechargeable batteries: nickel cadmium (Ni-Cd), nickel metal hydride (Ni-MH), lithium ion (Li-ion) and small sealed lead (Pb).
O. 
White goods: washers, dryers, ranges, refrigerators, air conditioners. Note: All devices that contain CFCs must be properly evacuated by licensed individuals and all CFCs recovered must be sent to an EPS-approved reclaimer.
P. 
Electronics: televisions, CPUs, monitors, laptops, and mercury-containing devices.
Q. 
Fluorescent bulbs: lamps that contain mercury.
R. 
Plastic film: stretch/shrink wrap, plastic shopping bags (only for warehouses, retail establishments, and supermarkets with 25 or more employees).
S. 
Wood scrap: unfinished lumber from new construction projects, including pallets. "Unfinished" shall mean non-chemically treated (not pressure treated, impregnated with preservatives, insecticides, fungicides, creosote or other chemicals, and not painted, resin-coated or otherwise surface treated, and not laminated or bonded, and not similarly altered from its natural condition).
The program which has previously been established for the mandatory separation of recyclable materials and for the mandatory separation of mixed paper, textiles, used motor oil and brush from other solid waste within the Borough of Middlesex is hereby continued and expanded as set forth in §§ 351-17 and 351-18 of this article.
A. 
Newspaper shall be separated, cross-tied in bundles not exceeding 35 pounds in weight or 15 inches in height and placed curbside for collection on scheduled collection days or brought to the recycling center for placement in the newspaper bin provided. Newspaper used to wrap solid waste may be disposed of with the garbage.
B. 
Corrugated cardboard shall be flattened and tied in bundles not exceeding 35 pounds in weight and placed curbside for collection or brought to the recycling center for placement in the cardboard bin provided.
C. 
All containers, glass (by color), aluminum, steel and plastic, shall be placed separated in suitable Borough or homeowner-supplied buckets for curbside collection or brought to the recycling center for placement in the properly labeled bin provided.
D. 
Mixed paper shall be placed separated at curbside for collection or brought to the recycling center for placement in the mixed paper bin provided.
E. 
Textiles shall be bagged and placed at curbside for collection or brought to the recycling center and placed in the textile-recycling container provided.
F. 
Used motor oil shall be collected separately and brought to the recycling center for disposal in the used oil tank provided.
G. 
Brush shall be bundled and tied with string or cord and placed curbside for a scheduled pickup or brought to the recycling center for placement in the brush bin provided.
A. 
The Borough of Middlesex shall provide or contract for the collection of mandated recyclables placed curbside by residential single-family households.
B. 
Business, industrial, commercial, institutional and government establishments shall continue to be responsible for private collection of their recyclables.
C. 
Mandated recyclables, once placed curbside for collection, shall become the property of the Borough of Middlesex.
D. 
It shall be unlawful for any person to collect or cause to be collected mandated recyclables placed at curbside unless specifically authorized to do so by the Mayor and Council of the Borough of Middlesex.
A. 
Instructions and schedules for recycling shall continue to be published in the official directory which is mailed annually to all postal addresses in the Borough.
B. 
Information regarding new or additional recycling services shall be disseminated to the public by means of the Borough newsletter. This publication is printed and mailed quarterly.
Pursuant to N.J.S.A. 13:1E-99.13a and 13:1E-99.16c:
A. 
Any application to the Planning Board of the Borough of Middlesex for subdivision or site plan approval for the construction of multifamily dwellings of three or more units, single-family developments of 50 or more units or any commercial, institutional or industrial development for the utilization of 1,000 square feet or more of land must include a recycling plan. This plan must contain, at a minimum, the following:
(1) 
A detailed analysis of the expected composition and amounts of solid waste and recyclables generated at the proposed development; and
(2) 
Locations documented on the application's site plan that provide for convenient recycling opportunities for all owners, tenants and occupants. The recycling area shall be of sufficient size, in a convenient location and contain other attributes (signage, lighting, fencing, etc.) as may be determined by the municipal recycling coordinator.
B. 
Prior to the issuance of a certificate of occupancy by the Borough of Middlesex, the owner of any new multifamily housing or commercial, institutional or industrial development must supply a copy of a duly executed contract with a hauling company for the purpose of collection and recycling of source-separated recyclable materials in those instances where the municipality does not otherwise provide this service.
C. 
Provisions shall be made for the indoor, or enclosed outdoor, storage and pickup of solid waste, to be approved by the municipal engineer.
A. 
Residential. Each major application for residential development shall include provisions for the collection, disposition and recycling of recyclable materials and refuse. Each multifamily complex must provide a sufficient number of bins in a convenient location or locations in a common area as drop-offs for storing refuse and recyclables until collection occurs. The holding area shall provide for truck access and loading and shall be suitably screened from view and set back from property lines. The screening shall include a solid wall and evergreen vegetation equal to or greater than the height of the storage receptacles.
B. 
Nonresidential.
(1) 
Each application for a nonresidential use which utilizes 1,000 square feet or more of land shall include provisions for the collection, disposition and recycling of recyclable materials and refuse. The applicant shall provide a screened storage area. The storage area shall be designed for truck access for pickup of materials and shall be suitably screened from view if located outside a building by a solid wall and evergreen vegetation equal to or greater than the height of the storage receptacles.
(2) 
All nonresidential uses shall provide a screened area for the storage of pallets, trash, and recyclable materials.
The Public Works Superintendent, Code Enforcers, Middlesex Borough Health Department and the Middlesex Borough Police Department are hereby authorized and directed to enforce this article. Fines and violations for noncompliance shall be in an amount not to exceed $500 for each offense.
