As used in this chapter, the following terms
shall have the meanings indicated:
MOTOR-DRIVEN VEHICLE
Every motor-driven vehicle not capable of being registered
under Title 39, Motor Vehicles and Traffic, of the New Jersey Statutes,
as amended and supplemented, except vehicles expressly exempted from
registration by said Title 39, and shall include but not be limited
to motorbikes, minibikes, trailbikes, motor scooters, go-carts, swamp
buggies and snowmobiles.
No person shall operate or shall permit or suffer
to be operated a motor-driven vehicle within the Township of Moorestown
under the following circumstances:
A. On the private property of another without the prior
express written consent of the owner, lessee and lawful occupant of
said property, which written consent shall be kept upon the person
of the operator of said motor-driven vehicle and available for immediate
inspection during all periods of said operation.
B. Upon any public grounds or property.
C. In such manner as to create loud, unnecessary or unusual
noise disturbing or interfering with the peace and quiet of other
persons.
D. Between the hours of 7:00 p.m. (or sunset, if sunset
occurs before 7:00 p.m.) and 9:00 a.m., prevailing time.
E. In a careless, reckless, negligent or wanton manner
endangering or likely to endanger the safety or property of any person,
including the operator.
Where any person under 18 years of age, residing
with parent or parents, guardian or guardians or other person or persons
having custody of said person, operates a motor-driven vehicle in
violation of the terms of this chapter, it shall be presumed that
said person operated said motor-driven vehicle with the permission
and by the sufferance of said parent or parents, guardian or guardians
or other person or persons having custody, as the case may be, but
said presumption may be rebutted by a clear and convincing showing
of evidence to the contrary.
