The Planning Board or the Board of Adjustment,
as the case may be, when acting upon applications for preliminary
or minor subdivision approval, or upon applications for preliminary
site plan approval, shall have the power to grant such exceptions
from the requirements for such approvals as may be reasonable and
within the general purpose and intent of the provisions of this chapter
if the literal enforcement of one or more provisions of this chapter
is impracticable or will exact undue hardship because of peculiar
conditions pertaining to the land in question.
Copies of this chapter shall be filed with the
County Clerk, the County Planning Board and the Township Clerk and
shall be made available to any persons desiring a copy upon the payment
of a fee established by the Township Committee.
Unless otherwise specifically provided herein, any violation of the provisions of this chapter shall be punishable as provided in §
1-3, General penalty, of this Code. Each day that a violation shall continue shall constitute a separate offense, except as otherwise set forth herein.
If any section, sentence, clause or phrase of
this chapter is for any reason held by a court of competent jurisdiction
to be invalid, such a decision shall not affect the validity of the
remaining portions of this chapter.
This chapter specifically repeals existing Chapters
11, 50,
78 and
84 of the Code of the Township of Morris. In addition, all ordinances and parts of ordinances inconsistent
herewith are hereby repealed to the extent of such inconsistency.
This chapter shall take effect immediately upon publication and final passage thereof as provided for by law, except for Part
