A Municipal Court, to be known as the "Municipal
Court of the Borough of Hasbrouck Heights," be and the same is hereby
established in and for the Borough of Hasbrouck Heights, Bergen County,
New Jersey, with the jurisdiction, powers and duties conferred by
the statute and the rules of the Supreme Court of this state.

Said Municipal Court shall have a Judge, to
be known as the "Judge of the Municipal Court," who shall be appointed
by the Mayor, with the advice and consent of the Borough Council,
for a term of three years and until a successor shall have been appointed
and qualified. Said Judge shall receive such compensation as set forth
in the Borough Salary Ordinance.
Said Municipal Court shall be held at the Municipal
Building of the Borough of Hasbrouck Heights and at such other places
in said Borough as the Judge may, from time to time, order.

There shall be a Clerk and such other officials
of the Municipal Court as shall be appointed from time to time by
the Mayor, with the advice and consent of the Council. Said Clerk
and other officials shall serve for a term of one year from the date
of their appointments and until their successors are appointed and
qualified. Said Clerk and other officials shall perform the functions
and duties as shall be prescribed for said Clerks by law, the rules
applicable to municipal courts and by the Municipal Judge and shall
receive such compensation as set forth in the Borough Salary Ordinance.

Any defendant appearing before the Municipal Court who seeks the representation of the Public Defender of this Borough as otherwise provided for by law and in §
45-9 of this Code shall be required to pay to the Borough through the Municipal Court Administrator a fee in the sum as set forth in Chapter
133, Fees, for such services unless the Judge of the Municipal Court shall reduce or waive entirely the imposition of the said fee upon a showing by the applicant of good cause for such reduction or waiver.

A. There is hereby established the office of Borough
Prosecutor which shall be composed of a Prosecutor and Alternate Prosecutors,
each of whom shall be an attorney at law of the State of New Jersey
in good standing and qualified to serve in such office under the Rules
of Court, each of whom shall be appointed by the governing body and
each of whom shall serve for a term commencing on the date of appointment
and ending on the 31st day of December of each year.
B. It shall be the duty of the Borough Prosecutor to
represent the State of New Jersey, the County of Bergen or the Borough
of Hasbrouck Heights in the prosecution of all offenses within the
statutory jurisdiction of the Municipal Court of the Borough of Hasbrouck
Heights, all as is more specifically set forth in N.J.S.A. 2B:25-5
and the Rules of Court.
C. The said Borough Prosecutor shall be compensated by
the payment of such amount and in such manner as may be more specifically
provided in the annual Salary Ordinance of the Borough.
D. The governing body shall appoint so many Alternate
Borough Prosecutors as from time to time it deems necessary. It shall
be the duty of any Alternate Borough Prosecutor when assigned to do
so by the Borough Prosecutor to serve in the absence of a Borough
Prosecutor as he or she would have been required to do.
E. Any Alternate Borough Prosecutor so appointed shall
be compensated for such services rendered on an hourly basis in an
amount and in the manner as may be provided in the annual Borough
Salary Ordinance.
