As used in this article, the following terms
shall have the meanings indicated:
Recyclable aluminum cans.
Beverage containers made of a lightweight, silver-white,
metallic element.

A business engaging in the business of recycling or otherwise
providing recycling services.
Source-separated nonputrescible recyclable material generated
from the construction, alteration, repair, maintenance and/or demolition
of structures within Bergen County. This material shall include concrete,
bricks, blocks, ferrous and nonferrous scrap, asphalt, asphalt shingles,
recyclable wood scrap and any and all other material generated from
the construction, alteration, repair, maintenance and/or demolition
of a structure or structures within Bergen County that a municipality
may deem recyclable.

Structural material shaped in parallel furrows and ridges
for rigidity, used to make packing and shipping containers.

All metal scrap containing steel and/or cast iron.

All products made from silica or sand, soda ash and limestone
which are transparent or translucent and used for the packaging or
bottling of various matter and all other materials commonly known
as "glass," but excluding, however, blue and flat glass commonly known
as "window glass."
All containers made from silica or sand, soda ash and limestone,
the product being transparent or translucent and being used for packaging
or bottling of various matter and all other material commonly known
as "glass," excluding, however, blue glass and plate glass commonly
known as "window glass."

All paper such as bond, stationery, computer printout sheets,
computer tabular cards, white or colored ledger paper, white or yellow
lined paper or copier paper and all other such paper, but not including
tissue paper, newsprint, corrugated cardboard, flat cardboard, magazine
paper or other such paper.

White typing and ledger paper, white notepad paper, copier
paper, carbonless computer printout, manila tab cards and file folders.

Those materials naturally formed from trees and bushes that
are suitable for composting and mulching purposes.

The disposition of designated recyclable materials, source-separated
in a municipality, which entails a disposition cost less than the
cost of transporting the recyclable materials to solid-waste facilities
and disposing of them as municipal solid waste at the facility utilized
by the municipality.
Source-separated mixture of all types of paper, including
but not limited to corrugated, high-grade paper, newspaper, magazines,
telephone directories, wrapping paper, box board, books, grocery bags
and junk mail.

All residential, commercial and institutional solid waste
generated within the boundaries of Hasbrouck Heights.
Paper of the type commonly referred to as newsprint and distributed
at stated intervals, usually daily or weekly, having printed thereon
news and opinions and containing advertisements and other matters
of public interest. Magazines and periodicals as well as all other
paper products of any nature are not considered "newspaper."

Includes all newspaper, high-grade office paper, fine paper,
bond paper, offset paper, xerographic paper, mimeo paper, duplicator
paper and related types of cellulosic material containing not more
than 10%, by weight or volume, of noncellulosic material such as laminates,
binders, coatings or saturants.
Any noncontaminated paper items or commodities, including
but not limited to paper napkins, towels, corrugated and other cardboard
and related types of cellulosic products containing not more than
10%, by weight or volume, of noncellulosic material such as laminates,
binders, coatings or saturants.
Any hermetically sealed container with a minimum wall thickness
of not less than 0.010 inch and composed of thermoplastic, synthetic,
polymeric material.
Any noncontaminated product generated by a business or consumer
which has served its intended end use and which has been separated
from solid waste for the purposes of collection, recycling and disposition
and which does not include secondary waste material or demolition
waste.
Those materials which would otherwise become municipal solid
waste and which may be collected, separated or processed and returned
to the economic mainstream in the form of raw materials or products.
Any paper having a total weight consisting of not less than
50% secondary wastepaper material.
Any paper product consisting of not less than 50% secondary
wastepaper material.
Any system by which materials which would otherwise become
solid waste are collected, separated or processed and returned to
the economic mainstream in the form of raw materials or products.
Any facility designed and operated solely for receiving,
storing, processing and transferring source-separated nonputrescible
or source-separated, co-mingled nonputrescible metal, glass, paper,
plastic containers and corrugated and other cardboard or other recyclable
materials approved by the Department.
The services provided by persons engaging in the business
of recycling, including the collection, processing, storage, purchase,
sale or disposition, or any combination thereof, of recyclable materials.
Such rules, implementation dates, schedules of times and
such other requirements promulgated by the Recycling Coordinator and
approved by the Borough Council as may be necessary to carry out the
purposes and objectives of this article.
Waste material generated after the completion of a manufacturing
process.
Paper waste generated after the completion of a paper-making
process, such as postconsumer waste material, envelope cutting, bindery
trimmings, printing waste, cutting and other converting waste, butt
rolls and mill wrappers, but excepting therefrom fibrous waste generated
during the manufacturing process such as fibers recovered from wastewater
or trimmings of paper-machine rolls, fibrous by-products of harvesting,
extractive or woodcutting processes or forest residue such as bark.
Recyclable materials, including but not limited to paper,
metal, glass, food waste, office paper and plastic, which are kept
separate and apart from residential, commercial and institutional
solid waste by the generator thereof for the purposes of collection,
disposition and recycling.
Enough receptacles for each premises to eliminate the need
for baskets, cartons and paper bags stored in loose condition at receptacle
locations.
Receptacles, as herein defined, so constructed as to prevent
spillage, having handles or other appurtenances thereto of such size
as to facilitate their emptying and which are maintained at all times
in a clean condition. A suitable Type 1 receptacle shall have handles
to enable it to be handled by one man and shall be filled to a weight
no greater than 25 pounds. A suitable Type 2 receptacle shall be one
commonly known as a "dumpster," having a capacity of no greater than
two cubic yards, and shall have standard appurtenant fixtures thereon
to facilitate dumping into standard garbage compactor trucks.
Cans made of steel or tin. The most common are tin-plated
steel cans which contain food.

Paper of the type commonly referred to as "newsprint," but
excluding, however, all magazines or similar glossy periodicals as
well as all other paper periodicals of any nature whatsoever.
Used appliances, such as refrigerators, washers, dryers and
stoves.

Leaves, grass clippings and brush.
Classes of businesses shall be as follows:
A.
Class I: a business employing fewer than 10 employees.
B.
Class II: a business employing 10 to 25 employees.
C.
Class III: a business employing more than 25 employees.
D.
Class IV: office buildings containing fewer than six
offices.
E.
Class V: office buildings containing more than six
offices.
F.
Class VI: multiple dwellings of three units or more.
G.
Class VII: hotels or motels.
H.
Class VIII: buildings containing a combination of
residences and business.
I.
Class IX: manufacturing plants.
A.
General. It shall be the further obligation, in all
of the aforenamed classes, for all persons, except those residential
classes who are exempted from the obligation to separate recyclables,
to separate high-grade paper from other paper.

B.
Residential premises. All persons, except those physically
disabled, who are owners, lessees and occupants of residential property
in the Borough shall separate used newspapers, aluminum, glass, plastics,
ferrous scrap, white goods, household-generated batteries, grass and
yard waste from any other trash and garbage produced by any such residences
and shall separately prepare the same according to all applicable
regulations.

C.
All commercial and multifamily premises. Owners, lessees
and occupants of commercial and multifamily locations shall separate
recyclables, further including but not limited to leaves, white goods
and construction and demolition debris, from their waste stream and
prepare and dispose of said materials in accordance with all applicable
regulations.

D.
Classes I, II and IV shall separate, store in suitable
receptacles, as designated by the Recycling Coordinator, and dispose
of recyclables according to regulations.
E.
Classes III, V, VII and IX shall separate and store recyclables in suitable receptacles, as designated by the Recycling Coordinator, and shall transport the same to the recycling depot of the Borough of Hasbrouck Heights at such times and in such a manner as the Recycling Coordinator may require hereunder, unless exemption is granted by the Recycling Coordinator pursuant to § 152-16 hereof, in which case a quarterly report of the weight or quantity must be made to the Recycling Coordinator in such manner as he requires.

F.
Class VI shall collect recyclables and store them
in a designated area properly prepared and accessible for collection
as scheduled.
G.
For Class VIII the owners of the building shall make
available storage areas for recyclables to be properly prepared; disposal
shall be designated by the Recycling Coordinator.
All separated recyclables shall be placed for
pickup and/or collection and recycling in strict conformity with the
following regulations:
A.
Used newspapers shall be separated and tied in bundles
not to exceed 12 inches in height. Such bundles shall not be contained
in plastic bags.
B.
Aluminum shall be separated and secured in sufficient
suitable reusable containers supplied by the owner, lessee or occupant.
C.
Glass shall be separated and contained in sufficient
suitable reusable containers supplied by the owner, lessee or occupant.
Containers constructed of paper or cardboard materials shall be deemed
not suitable for this purpose. The container, when filled, shall weigh
no more than 25 pounds.
D.
Other materials shall be separated and secured in
reusable containers supplied by the owner, lessee or occupant.
E.
Storage of recyclables shall be at a location which
shall not cause an unsightly or hazardous environment.
F.
High-grade paper shall be separated and stored in
conformity with the regulations of the Recycling Coordinator as hereafter
promulgated.

The Recycling Coordinator shall promulgate reasonable
regulations and establish the commencement dates for mandatory separation
of recyclables and the manner, dates and times for the collection
of the same in accordance with the terms of this article. Any such
regulations so promulgated shall become effective upon approval by
the Borough Council and may be changed, modified, repealed or amended
in whole or in part by the Borough Council. A copy of such regulations
promulgated by the Coordinator, as approved, modified or amended,
shall be available for public inspection at the office of the Department
of Public Works during regular office hours.
From the time of placement at the curb for pickup,
collection and recycling, recyclables shall be the property of the
Borough of Hasbrouck Heights or its duly authorized agent. No person
unauthorized by the Borough of Hasbrouck Heights shall collect or
pick up or cause to be collected or picked up any such recyclables.
Each collection or pickup of recyclables in violation hereof shall
constitute a separate and distinct offense.
No provision herein shall be construed to prohibit
groups or individuals who shall be authorized by the Recycling Coordinator
from collecting or picking up recyclables at curbside or otherwise
in such manner and under such terms and conditions as shall be prescribed
by the Coordinator. No such collection or pickup shall conflict or
interfere with pickup and collection by the Borough or its duly authorized
agents.

The Recycling Coordinator may exempt persons
occupying commercial and institutional premises from the source-separation
requirements of this article if those persons have otherwise provided
for the recycling of the recyclable materials designated in the district
recycling plan from solid waste generated at those premises. To be
eligible for an exemption pursuant to this section, a commercial or
institutional solid-waste generator annually shall provide written
documentation to the Recycling Coordinator of the total number of
tons recycled.
The Superintendent of Public Works is hereby
designated the Recycling Coordinator of the Borough of Hasbrouck Heights.
The Director of the Department of Solid Waste
Management or his duly authorized designee is hereby designated and
authorized as the enforcement officer of this article.
