As used in this article, the following terms
shall have the meanings indicated:
COMPOSTABLE LEAF AND GRASS REFUSE
Grass clippings, weeds, garden, plant and vegetable cuttings
and leaves or a mixture thereof purely of organic matter and subject
to decay.

Within the limitations hereinafter established,
the Borough of Hasbrouck Heights will provide collection of such compostable
leaf and grass refuse generated from all residential premises within
its boundaries according to such schedule as may be hereafter established
by regulation adopted in accordance herewith, except such compostable
leaf and grass refuse as may be gathered up from such premises by
a commercial enterprise which shall be required to remove that refuse
itself, unless such refuse is left by the commercial enterprise with
the property owner for disposal by the property owner in accordance
with the terms hereof.
The Mayor and Council may, by resolution, establish additional rules and regulations in respect to the matters contained herein in the same manner as provided in §
152-6 of this chapter.

It shall be unlawful for any person, firm or
corporation to deposit or place any leaf or grass refuse into the
solid waste stream for collection or disposal as solid waste.

Any person, firm or corporation who shall violate any provision of this article shall, upon conviction thereof, be subject to such penalties as are provided in Chapter
204 of this Code. In fixing the fine provided under Chapter
204, the court shall consider the additional or extraordinary cost to the Borough resulting from the violation of the terms of this article, as such cost may be certified to the court by the Superintendent of Public Works.
