[Adopted 12-18-1962 (Ch. 162, Art. III, of the 1974 Code)]
As used in this article, the following terms shall have the meanings indicated:
FOOD
Includes any drink or beverage intended for human consumption.
FOOD HANDLER'S CERTIFICATE
The permit or license issued or granted to any person by virtue of this article.
PERSON
Any person who handles food or drink during preparation, processing or serving, or who comes in contact with any eating or cooking utensil or who is employed in a room where food or drink is prepared or served and includes any individual, firm, corporation, association, society or partnership and their agents, officers or employees.
RETAIL FOOD-HANDLING ESTABLISHMENT
Includes restaurants, taverns, box lunch establishments, bakeries, meat markets, delicatessens, luncheonettes, caterers, soda fountains, food vending vehicles and any other place in which food or drink is prepared or stored for public consumption, distribution or sale at retail, including vehicles used in connection therewith, and all places where water for drinking or culinary purposes is available for public use.
UTENSILS
Any kitchenware, tableware, glassware, cutlery, containers or other equipment with which food or drink comes in contact.
No person shall engage in or be employed in the business or service of handling, preparing, processing, storing, selling or serving food, or handling or washing utensils in a retail food handling establishment, whether intended for immediate on or off-premises consumption, without first having obtained a food handler's certificate, upon written application from the Board of Health of the Borough of Totowa, nor shall any person employ, use or allow anyone to be a food handler unless such person shall first have obtained such certificate from the Board of Health.
A. 
A food handler's certificate will be issued after presentation by the applicant to the Board of Health of a certificate of examination from a duly qualified physician licensed to practice in this state, which shall include the employment of standard and recognized methods for determining the presence of communicable disease. The findings shall be recorded upon blanks provided by the Board of Health for that purpose.
B. 
A fee of $1 shall be charged for the issuance of a food handler's certificate, which must be carried on the person to whom issued when handling food or drink, and presented upon request to any member of the Board of Health or any authorized representative.
C. 
The food handler's certificate shall expire on June 30 each year.
In order to secure a food handler's certificate, the medical examination of a person must be made within 15 days before application is made to the Board of Health for a food handler's certificate and it must show the person to be free from:
A. 
Communicable diseases.
B. 
Open lesions of the hands, face or neck and acne of the face.
C. 
Evidence of acute or chronic inflammatory conditions of the respiratory tract.
D. 
Pathogenic intestinal organisms as determined by stool examinations.
No person to whom a food handler's certificate is issued or granted shall give, loan, transfer or permit the same to be used by any other person, for any purposes whatsoever.
A. 
The food handler's certificate, when granted, shall be valid until the same is suspended or revoked or it expires.
B. 
For good cause shown and on written notice to any person holding a food handler's certificate, the Board of Health expressly reserves the right to suspend or revoke any food handler's certificate issued or granted pursuant to this article.
All employers engaged in the business or service of preparing and processing food intended for human consumption, whether for immediate on- or off-premises consumption, shall at all times keep and maintain accurate records of the name and address of each employee, date of employment, the date of the issuance of said food handler's certificate and the number thereof, which record shall be available at all times for inspection by the Board of Health, or any of its accredited agents or representatives.
