A. The City Treasurer shall have charge of the Treasury
Department and the collection of taxes and all accounts receivable.
He or she shall be appointed by the Mayor, subject to confirmation
by the Council, for the term of three years and until his or her successor
is duly appointed and qualified. The Treasurer shall by virtue of
his or her office also serve in the Department of Finance and Administration.

B. Parking Control Supervisor. The City Treasurer shall
also serve as the City's Parking Clerk. There is hereby also established
the position of Parking Control Supervisor, who shall work under the
general direction of the City Treasurer/Tax Collector as the administrator
and manager of the City's parking garages and parking control activities.
Notwithstanding his or her general responsibilities for management
of the parking systems, the Parking Control Supervisor shall have
the following specific duties:

(1) Manage and oversee all aspects of the City of Fitchburg's
parking garages including but not limited to:
(a)
The maintenance and cleaning of garages and
parking lots;
(b)
Management and oversight of customer accounts
and billing;
(c)
Collection from and handling of delinquent rent
payers;
(d)
Monitoring of parking activities;
(e)
Solicitation of new customers as monthly/quarterly
rentals.
(2) Supervision of metered parking:
(a)
Monitor all of the City's parking meters including
on-street meters and meters in surface lots;
(b)
Maintenance of all broken meters and all equipment
needed for parking lots.
(3) Supervision of parking meter employees:
(a)
Supervise all parking meter employees and all
paid parking matters to ensure appropriate enforcement;
(b)
Maintain the security of garages, parking meters
and receipts.
(4) General accounting.
(a)
Provide and maintain a general accounting of
all garage and parking activities and finances;
(b)
Establish and maintain detailed schedules of
rental billings, collections, collection activities and outstanding
receivables.
C. Parking garage rate structure. The rate structure
for the parking garages shall be as follows:
(1) The hourly rate shall be $0.50;
(2) The rate for reserved spaces shall be $120 per quarter
year;
(3) The rate for a nonreserved space shall be $75 per
quarter;
(4) The rate for a reserved rooftop space shall be $45
per quarter.
D. All parking meter and parking garage receipts shall
be directed to "parking meter receipts."
E. City employee parking at Boulder Drive/Putnam Street Garage. The
City Treasurer, as Parking Clerk, may designate up to 60 spaces in
the Boulder Drive/Putnam Street Parking Garage necessary for use by
City employees during the time City Hall offices are relocated to
Putnam Place. City employees parking in the designated spots will
not be required to pay a fee for parking at the Boulder Drive/Putnam
Street Garage in the designated spots, between the hours of 8:00 a.m.
and 5:00 p.m., Monday through Friday, so long as they have a City
Hall parking permit/hangtag affixed to their vehicle.

The City Treasurer shall give a bond with sufficient
sureties to be approved by the Council, in a sum not less than the
amount established by the Commissioner of Corporations and Taxation,
for the faithful performance of his or her duties as Treasurer and
Collector, which shall be executed, approved and delivered to the
City Clerk before he or she enters upon the duties of his or her office
and within 10 days after his or her appointment and confirmation.
Should the City Treasurer fail to give such bond within the time herein
required, the appointment shall be void and a new appointment shall
be made. In case of the death or insolvency of any of the sureties
of any bond so given, the Treasurer shall immediately give a new bond
with sufficient sureties as hereinbefore provided, and if he or she
fails to give such a new bond within 10 days after notice to do so,
it shall be sufficient cause for his or her removal from office. The
bond of the Treasurer shall be kept by the City Clerk, who, upon receipt
of the same, shall give written notice thereof to the Mayor.

The Treasurer shall keep, in books provided
for that purpose, an accurate and true account of all his or her receipts
and payments on behalf of the City, making the same conform as nearly
as may be to the accounts kept by the City Auditor.

The Treasurer shall, at the close of each month,
transmit to the Auditor a statement in detail of his or her collections
and receipts during the month, with the names of the persons from
whom and the purpose for which the same was received; provided that
it shall be sufficient, in reporting the receipts for taxes, assessments
and water rates, to state the full amount received.

The Treasurer shall, at the close of each financial
year, make a written report to the Mayor of the condition of the treasury
and of all moneys received and paid out by him or her during the year.

The Treasurer is authorized to pay from the
treasury all warrants drawn on him or her by the Auditor and duly
approved by the Mayor, but he or she shall pay no money out of the
treasury unless upon warrants so drawn.

The Treasurer shall negotiate and sell all bonds
authorized by the Council, provided that no bond, note or other evidence
of indebtedness of the City shall be negotiated or sold by him or
her until the terms of such negotiation or sale are approved by the
Mayor. All bonds and notes issued by the City shall be signed in the
manner and by the officials provided by laws and shall have the City
Seal affixed thereto. All bonds shall, upon the face thereof, be properly
denominated and shall show the general purpose for which they were
issued.
A. The City Treasurer shall demand payment in writing
of all accounts due the City, and in case any such account, except
taxes, remains unpaid at the expiration of two months after such demand,
the City Treasurer shall report the same to the City Solicitor, who
shall resort to the proper legal methods of collection. He or she
shall furnish the City Auditor with statements showing the amount
of all bills uncollected, with a memoranda of the account to which
they are to be credited when paid.

B. All invoices originating from and due the City of
Fitchburg which are mailed to taxpayers and/or citizens and all others
shall be in sealed containers.

All accounts shall be paid to the Treasury Department.
The City Treasurer and City Collector is the only authorized person
to receive money for the City. All bills paid the City shall have
the stamp of that Department unless otherwise expressly provided.

The City Treasurer may issue registered certificates
in accordance with the provisions of MGL c. 107, § 4, in
substitution for any mutilated or defaced bond, note or certificate;
and where a note, bond or certificate has been lost or destroyed,
the City Treasurer may issue in place thereof a new note, bond or
certificate with the same effect. He or she shall keep a register
of the dates, numbers and amounts of all bonds, notes and certificates,
showing by whom they were issued, when they are payable and, if issued
in exchange, for what they were substituted.

The Treasurer, during his or her term of office,
shall serve as a member of the Trustees of Burbank Hospital.

The City Treasurer shall be the custodian of
all funds and securities of all trust funds given or bequeathed for
the benefit of the City or the inhabitants of the City, unless the
donor in making the gift or bequest shall otherwise provide. He or
she shall invest and reinvest them and expend therefrom moneys as
directed by the Commissioners of Trust Funds of the City of Fitchburg.
The Treasurer shall furnish a bond satisfactory to the Commissioners
of Trust Funds for the faithful performance of his or her duties.

Except for trusts and gifts managed by the Board
of Commissioners of Trust Funds, the City Treasurer shall, so far
as consistent with the terms of the trust funds, manage and control
the same and distribute the income in accordance with the terms of
the respective trusts. He or she shall keep a record of his or her
transactions and, at the close of each fiscal year, shall make a report
to the City, showing the total amount of the funds and the amount
of receipts and disbursements of the same, setting forth in detail
the sums of receipts and the purposes of expenditures.
