The Board of Park Commissioners shall consist
of five persons appointed by the Mayor, subject to confirmation by
the Council, for the terms and in the manner provided in MGL c. 45,
§ 2, and shall serve without compensation.
It shall be the duty of the Park Commissioners
to manage, direct, equip, care for and have charge of all public pleasure
grounds, playgrounds and of the planting and care of trees and shrubs
therein, the conduct and use thereof, the employment of teachers,
supervisors and other officials therefor and the construction, care,
alteration and maintenance of all buildings, structures or other property
pertaining thereto.
The Board of Park Commissioners shall exercise
the powers conferred by MGL c. 45, § 14, upon the municipality
with reference to the laying out, use and control of playgrounds.
The Board of Park Commissioners may employ and
remove such assistants and employees as may be necessary for the efficient
administration of its duties and fix their compensation.
The Board of Park Commissioners shall have power
to organize and conduct its business under such rules and regulations
as it may deem proper, provided that the same are not inconsistent
with the laws of the commonwealth or the Charter and ordinances of
the City. It may also adopt all reasonable regulations regarding the
use of the land and buildings under its permanent or temporary control.
The Board of Park Commissioners shall have the
authority, with the approval of the City Council, to institute a system
of charges and fees for admission to sports events or special attractions
conducted by or under the supervision of the Board of Park Commissioners.
The charges or fees so to be charged shall be published in a newspaper
published within the City, upon their being determined, at least 14
days prior to the date they are to take effect, and shall also be
posted in a conspicuous place on the field or fields where such charges
or fees are to be made.
All amounts collected as charges and fees are
to be deposited in a separate account to be known as "Park Department
Receipts Account," and the funds so collected and deposited shall
be used solely for recreational improvements of the park and recreation
areas of the City.
All charges and fees as collected shall be turned
over to the City Treasurer for deposit in the special account created
by the preceding section on the morning following the game or entertainment
or, for weekend games, on the following Monday morning.

The Board of Park Commissioners will employ
and remove, subject to the provisions of the Civil Service Act, a
Superintendent of Parks, Playgrounds and City Forester, who shall
not be a member of the Board but who shall act under its direction
and control and subject to the terms of the Civil Service Act, and
the Board may fix his or her compensation. The Superintendent of Parks,
Playgrounds and City Forester may hold the office of Superintendent
of Gypsy and Brown-Tail Moths or either of them. The Superintendent
of Parks, Playgrounds and City Forester shall serve as executive officer
of the Board.

The Superintendent of Parks, Playgrounds and
City Forester shall have charge of the office of Tree Warden in accordance
with the provisions of MGL c. 87, § 2. He or she shall have
the care of shade trees within the limits of the highways and about
public buildings and shall have charge of the planting and care of
trees and shrubs on all grounds or lands owned by the City, except
public burial grounds and land owned by the City for the protection
of its water supply.

The Superintendent of Parks, Playgrounds and
City Forester shall have charge of the office of Superintendent of
the Suppression of Gypsy and Brown-Tail Moths in accordance with the
provisions of MGL c. 132, § 13. He or she shall make and
keep an itemized account showing the definite amounts expended for
the purposes named in MGL c. 132, § 12, and for the suppression
of the gypsy and brown-tail moths. He or she shall, under the direction
of the Mayor, cause notices to be sent to the owners of parcels of
land infested with moths, as required by law. He or she shall also
make true lists of the amounts expended upon real estate as provided
by law, containing the names of the owner of estates, the location
thereof and the amounts expended thereon.
