A.
FEE
MUNICIPAL AGENCY
Definitions. For the purposes of this article, the
following definitions shall apply:
Any fee, cost, charge, other than a tax, assessment or betterment
paid or required to be paid by any user of municipal service imposed
by a municipal agency, including any user fee or regulatory charge
for licenses, inspections or other governmental services.
Any board, commission, department, branch or division of
the government of the City of Fitchburg now existing or hereinafter
established.
B.
No municipal agency shall impose any fee, or change
any fee imposed by it, for services performed by the agency except:
(1)
As established, set or mandated by state or federal
law;
(2)
As authorized by state or federal law by a municipal
agency whose authority to establish such fee is subject to state or
federal law and not subject to regulation imposed by the City of Fitchburg;
or
(3)
As expressly approved by a vote of the City Council.
C.
This article shall not apply to nor affect any fees
set or established as of this date of enactment, but shall apply to
any changes in fees or the imposition of newly created fees after
its enactment.
