Any person who intends to erect, repair or take down any building on land abutting on any way which the Town is obliged to keep in repair, and desires to make use of any portion of said way for the purpose of placing thereon building materials or rubbish shall give notice thereof to the Select Board. And thereupon the Select Board may grant a permit to occupy such a portion of said way to be used for such purpose as in their judgment the necessity of the case demands and the security of the public allows, such permit in no case to be in force longer than 90 days and to be on such conditions as the Select Board may require, and especially in every case upon condition that lighted lanterns shall be so placed as effectually to secure all travelers from liability to come in contact with such building materials or rubbish.

A.
No person, except the Highway Surveyor, in the lawful performance of the Surveyor's duties, or those acting under the Surveyor's orders, shall make or cause to be made any excavation in a public street or way, for any purpose whatever, without having first obtained written permission from the Surveyor of Highways acting for and in behalf of the Select Board.
B.
When an excavation is made in a street for any purpose, the person or persons by whom or for whom such excavation has been made shall cause a rail or other sufficient fence to be placed so as to enclose such excavation, and the dirt, gravel or other material thrown therefrom, and such fence shall be maintained the whole time that such excavation continues.
C.
Such fence, excavation and material excavated shall be lighted by a lantern, lanterns, or other proper and sufficient light, from the beginning of twilight throughout the whole of every night, during the entire time that such excavation or construction exists.
No person shall obstruct a public street or sidewalk by placing or causing to be placed therein any article or thing whatsoever, and suffer the same to remain in such position for more than five minutes, without first having obtained written permission from the Select Board so to do, but nothing herein shall be construed to authorize the Select Board to issue permits for the use of any portion of a highway for business purposes.
No person, corporation or organization shall solicit or cause to be solicited money, either by selling of tags or in any other manner, upon the public ways of the Town of Marblehead without first obtaining a permit to do so from the Select Board.
Such permit may be granted by the Select Board subject to such conditions as the Select Board may impose.
Any person, corporation, or organization violating the provisions of the three preceding sections shall be subject to a fine of not more than $10 for each offense.
