A. 
All semipublic and public pools (swimming, wading, special purpose, water parks) in Middleton shall be licensed annually by the Board of Health.
B. 
All proposed semipublic and public pools (swimming, wading, special purpose, water parks) in Middleton shall be reviewed and approved by the Health Department prior to construction.
C. 
The licensing fee shall be $200 per year per indoor and $200 per year per outdoor pool for all public and semipublic swimming, wading, and special purpose pools.
D. 
All swimming pools shall comply with 105 CMR. 435.000: Minimum standards for swimming pools (State Sanitary Code: Chapter V); 780 CMR: The Massachusetts State Building Code; 310 CMR 15.000: The State Environmental Code, Title 5, and all local bylaws, codes, and regulations.
E. 
All recreational camps and water parks for children/youth that have a public and semipublic pool(s) shall have lifeguards, and the number shall conform to the requirements set forth in 105 CMR. 435.000: Minimum standards for swimming pools.
A. 
An inspection shall be required prior to opening of pools for seasonal use. The lifeguard must be in attendance for this inspection.
B. 
Indoor pools shall be inspected at least annually prior to issuance of the next year's license.
In the case of indoor pools there shall be large signs displayed with the following statements in two-inch lettering:

Per order of the Board of Health:
(1) 
No swimming alone is allowed.
(2) 
Use of alcoholic beverages in the swimming area is not allowed.
(3) 
No glass or dangerous objects are allowed in or around the pool area.
(4) 
No plastic inflatables are allowed as flotation devices in the pool.
(5) 
No child below 12 years of age is allowed in the pool unattended by an adult.
(6) 
Pool users are to take a cleansing shower before entering the pool.
(7) 
No one with a communicable disease is allowed into the pool.
(8) 
No common towels, cups, brushes, etc., are to be used at pool side.
(9) 
This pool is not attended by a lifeguard. Persons using the pool do so at their own risk.
(10) 
No diving in the pool is allowed.
(11) 
Do not run on the pool deck.
Pool operators shall maintain a pool log. Persons using the pool may sign in or be counted by the lifeguard.
Pool water shall be tested daily for the presence of proper sanitizer concentrations. Results of such tests will be entered into the permanent log book. No pool will be open that does not have daily sanitizer applications. Days and times when the pool is open will be posted in unattended pools.

B. 
In accordance with the Town of Middleton Stormwater Management and Illicit Discharge Bylaw, § 204-16, discharge from dechlorinated swimming pool water (less than one ppm chlorine) is permissible, provided that the water is allowed to stand for one week prior to draining and the pool is drained in such a way as not to cause a nuisance.
