A. 
The planning and zoning laws of the Village of Cazenovia (Village) provide, in certain instances, for the payment by the applicant of extraordinary professional fees incurred by the Village for certain applications.
B. 
It is the policy of the Village to provide for an appeal to this Board of Trustees in those instances in which the applicant believes the imposition of or amount of the fees is inappropriate, discriminatory or unreasonable.
The Village Board of Trustees shall:
A. 
Endeavor to hear all appeals at its next regularly scheduled meeting.
B. 
Determine whether the fees are discriminatory or inconsistent with fees assessed upon applicants in similar circumstances.
C. 
Take into consideration the hourly rates for fees charged routinely to the Village.
D. 
Not permit legal fees for the subdivision portion of any application, but engineering and other professional fees shall be permitted.
E. 
Ensure that the fees are audited and are necessary to the accomplishment of regulatory and proprietary functions.
