No person shall plant or set out any tree known
as a poplar, cottonwood or willow tree on or along any street within
the Village of Central Square or in any place where it will or does
affect, injure or endanger in any way any sewer, drain, water main,
catch basin, gutter or sidewalk. All such trees are deemed to be a
public nuisance and a menace to sewers, catch basins, drains, gutters
and sidewalks, and all persons owning or in control of any such tree
shall cut down and remove such tree if directed to do so by the Board
of Trustees. If any person owning or in control of any such tree shall
refuse to cut down and remove such tree within a reasonable time after
notice in writing from the Board of Trustees to do so, such tree shall
be cut down and removed by the Village. The expense of removal shall
be assessed against the property upon or adjoining which such tree
may stand.
No person shall cut, girdle or otherwise willfully
injure any shade or ornamental tree or shrub in or upon any street
or other public place of the Village, except as otherwise provided
in this Municipal Code.
No person shall cut down any tree upon any street
or public place within the Village without obtaining the consent of
the Board of Trustees and without providing indemnity for the Village
against any claims arising therefrom.
