As used in this chapter, the following terms shall have the
meanings indicated:
DEBRIS or ABANDONED PERSONAL PROPERTY
Includes ordinary household or store trash of a flammable
or nonflammable character, including but not limited to boxes, crates,
furniture, rugs, clothing, rags, barrels, cartons, mattresses, blankets,
rubber tires, lumber, timber, brick, stone and other building materials
no longer intended or in condition for ordinary use, abandoned motor
vehicles or the parts thereof and any and all tangible personal property
no longer intended or in condition for ordinary and customary use.

GARBAGE
Includes waste food, papers, dead animals or parts thereof
and all waste or discarded wood, lumber or vegetable matter of any
kind, or any other matter which shall be flammable or capable of fermentation
or decay.
PERSON
Includes an individual, society, club, firm, partnership,
corporation or association of persons, and the singular number shall
include the plural number.
RUBBISH
Includes waste metal, tin cans, ashes, cinders, glass, pottery
and all discarded substances of a solid and noncombustible nature.
The premises owned by the Town of Geneseo, situate on both sides
of the Warner Road as described in a deed to the said Town from Donald
J. Noble and Mary E. Matt, by deed dated September 3, 1968, and recorded
October 1, 1968, in the Livingston County Clerk's office in Liber
398 of Deeds at page 652, is hereby designated as the landfill site
of this Town for rubbish and garbage by the residents of the Town,
subject to the provisions of this chapter. The regulations herein
contained shall also apply to any other lands hereafter acquired or
leased for the purpose of disposal of rubbish and garbage.
No person shall carry or leave or cause to be carried or left upon the premises mentioned in §
70-2 of this chapter any automobile, vehicle, machine, appliance or other article or any part thereof unless the same shall have been dismantled and the body thereof so cut and flattened out as to permit the same to occupy a minimum of space.
No person not a resident of or conducting an established business
in the Town of Geneseo shall deposit any rubbish or garbage of any
kind on the premises herein designated for that purpose.
No rubbish or garbage originating in any place except in the
Town of Geneseo shall be disposed of at said sanitary landfill site
or in any other place in the Town of Geneseo.
No person shall deposit or cause to be deposited any substance
of any kind on the sanitary landfill site herein designated except
at the places and in the manner directed by the person in charge of
the premises under authority of the Town Board, whether such direction
is given personally or by another person by his authority or by a
sign or signs erected upon the premises by his authority.

A. Punch cards permitting use of the landfill may be obtained by a person
who qualifies hereunder at a fee to be determined by resolution of
the Town Board.

B. The hours of operation of the landfill shall be fixed by resolution
of the Town Board.
C. Dumping of garbage, rubbish or other refuse on a commercial basis
for a fee or as a business is hereby discontinued and prohibited.

No person shall throw, place, dump, deposit or cause to be thrown,
placed, dumped or deposited any rubbish, garbage, debris or abandoned
personal property, as defined herein, on any public or private highway,
street or place within the Town of Geneseo, except upon the Town transfer
station site aforesaid pursuant to the regulations hereof. This prohibition
shall not apply to such items placed for immediate commercial or municipal
trash pickup or removal.

Any person violating any of the provisions of this chapter shall
be guilty of a violation and, upon conviction thereof, be punishable
by a fine not exceeding $250 or by imprisonment for a term not to
exceed 15 days, or both, for each offense. Each day such lands are
so used as a dump, dumping ground, refuse disposal area or landfill
site shall constitute a separate violation. Each separate violation
shall be punishable as herein set forth. Each deposit or rubbish or
garbage on lands within the Town of Geneseo not established as a sanitary
landfill site shall constitute a separate violation of this chapter.
Any person who or whose servants, agents, employees or officers
shall be convicted of a violation hereof may thereafter be denied
the use of such dumping ground either temporarily or permanently by
the officer or employee in charge thereof or by resolution of the
Town Board.
