A. 
It shall be prohibited to open burn any materials in the Town of Sweden unless a permit has been obtained from the Town Clerk.
B. 
Permits will only be issued for the purpose of burning tree stumps, branches, incidental wood scrap material and brush cleared from land used for agriculture.
C. 
Each burning event shall require a separate permit.
Applications shall include the following:
A. 
The name and address of the property owner.
B. 
A map indicating the location of the material to be burned.
C. 
A description of the material to be burned.
D. 
The proximity of neighboring dwellings and structures.
E. 
Payment of the required fee, as established by the Town Board.
After issuance of a permit, the property owner shall give twenty-four-hour notification to the Code Enforcement Officer of the intent to burn.
The burning of garbage, plastic, rubber, bedding, paint cans and other petroleum-based products or hazardous waste shall be strictly prohibited and cause for immediate revocation of the permit and may result in further civil action and penalties. In addition, green or wet material shall be required to be seasoned or allowed to dry before the issuance of a permit.
Residents of one-, two- and three-family dwellings may be permitted to conduct a recreational fire after review of circumstances by the Code Enforcement Officer. Recreational fires do not include burn barrels or any other fire events that contain household rubbish.

Violations of this chapter shall be subject to a penalty of not more than $250 or imprisonment for not more than 15 days, or both.
