Editor's Note: Pursuant to Ord. No. 185, adopted 1-26-1989, the
Board of Supervisors expressed its intent and desire to acquire the assets
of the Sewer Authority and agreed to assume all obligations of the Sewer Authority
as obligations of Whitpain Township.
The Supervisors of the Township of Whitpain, Montgomery County, Pennsylvania,
hereby signify their intention to organize a municipality authority under
the Municipality Authorities Act of 1945, as amended.[1]

The Supervisors of the Township of Whitpain are hereby authorized and
directed to execute on behalf of said township Articles of Incorporation for
such an authority in substantially the following form.[1]

The Secretary of the Supervisors of the Township of Whitpain is hereby
directed to cause a notice of this article to be published as required by
Section 3 of the Municipality Authorities Act of 1945, as amended.[1]

The proper officers of the Township of Whitpain are hereby directed
to file the above Articles of Incorporation, together with the necessary proofs
of publication, with the Secretary of the commonwealth, and to do all other
acts and things necessary or appropriate to effect the incorporation of the
Whitpain Township Sewer Authority.
A.
The initial project to be undertaken by the Authority
is a sewage collection system to be leased to the Township of Whitpain and
the provision of facilities for the treatment and disposal of the sewage in
cooperation with the Townships of Lower Gwynedd and Upper Dublin and the Borough
of Ambler and any municipal authority that may be organized by any of them.
B.
In addition to the initial project, the Authority is
hereby authorized to undertake such further projects designed to benefit the
Township of Whitpain as may appear to it necessary or desirable and which
it is empowered to undertake under the provisions of the Municipality Authorities
Act of 1945.

The persons named and the terms of office set forth in the fifth Article of the Articles of Incorporation, the execution of which is authorized and directed by § 5-2 hereof, are hereby appointed as the first members of the Board of the Authority, and their terms of office shall commence on the date of appointment and shall be computed from April 1, 1959.

The initial project to be undertaken by the Authority
is the acquisition of certain lands situate in the Township of Whitpain for
the purpose of developing the same as a park and recreational area for the
citizens of Whitpain Township.
B.
In addition to the initial project, the Authority is
empowered to acquire, hold, construct, improve, maintain and operate, own,
lease, either in the capacity of lessor or lessee, lands situate in Whitpain
Township for buildings to be devoted wholly or partially for public uses,
including but not limited to a town hall and related buildings, for flood
control projects, parks, recreation grounds and facilities, swimming pools
and playgrounds.
