B.
The following discharges which may be allowed, based on a finding by Whitpain Township that the discharge(s) do not significantly contribute to pollution to surface waters of the commonwealth, are:
(1)
Discharges or flows from fire-fighting activities.
(2)
Non-contaminated water from pumped ground water and water from foundation footing drains and crawl space pumps.
(3)
Discharges from potable water sources, including dechlorinated water line and fire hydrant flushings, if such discharges do not contain detectable concentration of total residual chlorine (TRC).
(4)
Non-contaminated irrigation water, water from lawn maintenance, landscape drainage and flows from riparian habitats and wetlands.
(5)
Pavement wash waters where spills or leaks of toxic or hazardous materials have not occurred (unless all spill material has been removed) and where detergents are not used.
(6)
Residential (i.e., not commecial) vehicle wash water where cleaning agents are not utilized.
(7)
Routine external building wash down (which does not use detergents or other compounds).
(8)
Non-contaminated HVAC condensation and water from geothermal systems.
(9)
Dechlorinated swimming pool discharges.
(10)
Diverted stream flows and springs.
C.
In the event that Whitpain Township or DEP determines that any of the discharges identified in Subsection B significantly contribute pollutants to a regulated small MS4 or to the waters of the commonwealth, Whitpain Township or DEP will notify the responsible person to cease the discharge.
D.
Upon notice provided by Whitpain Township or DEP under Subsection C, the discharger will have a reasonable time, as determined by Whitpain Township or DEP, to cease the discharge consistent with the degree of pollution caused by the discharge.
E.
Nothing in this section shall affect a discharger's responsibilities under state law.
