This article is adopted and enacted pursuant to the authority
conferred by the New York State Municipal Home Rule Law, which enables
local governments to adopt local laws relating to their property,
affairs, or government, as long as the local laws are not inconsistent
with the New York State Constitution or any general law of New York
State. Specifically, this article is amending and revising § 3
of the New York State Public Officers Law, which requires every elected
or appointed officer of the Town to be an elector of the Town; thereby,
creating a Town residency requirement.

A candidate for the Office of Assessor, Zoning Officer or Code
Enforcement Officer may be appointed so long as they are an elector
in Genesee County or any county contiguous with Genesee County.
