A. 
An Arts Commission, to consist of seven members, is established for the Borough. The members of the Arts Commission shall be appointed by the Mayor, with the advice and consent of the Borough Council, and shall be citizens and shall live or work in the Borough of Highland Park. No more than one member shall be a nonresident. All members shall serve without compensation.
B. 
The members of the Commission who are first appointed shall be designated to serve for terms of one, two, three, four and five years, respectively, from the date of their appointments. Thereafter, members shall be appointed as aforesaid, for a term of three years, except that all vacancies shall be filled for the unexpired term only. The term of office of the Commission shall commence on August 1 of each year.
C. 
There shall be six alternate members of the Arts Commission, appointed by the Mayor, with the advice and consent of the Borough Council. The alternate members shall be designated at the time of appointment as "Alternate No. 1," "Alternate No. 2," "Alternate No. 3," "Alternate No. 4," "Alternate No. 5" and "Alternate No. 6." The terms of the alternate members shall be for three years, except that the first appointed "Alternate No. 1," "Alternate No. 2" and "Alternate No. 3" shall serve for three years, and the first appointed "Alternate No. 4," "Alternate No. 5" and "Alternate No. 6" shall serve for two years. Alternate members may vote in the absence of a regular member. In the event that a choice must be made as to which alternate member is to vote, the lowest numbered alternates shall vote, beginning with Alternate No. 1, until the Commission has reached a quorum.

One of the members shall be elected by the members of the Arts Commission as Chairman, and it may have such other officers as it deems necessary.

A. 
The purpose of the Arts Commission shall be to conduct cultural programs such as, but not limited to, art exhibits, plays, concerts, dance recitals and other similar activities for the benefit of residents of Highland Park.
B. 
In pursuance of such purposes, the Arts Commission shall have all powers reasonable and necessary to carry out its purposes. Such powers shall include, but are not limited to the following:
(1) 
To solicit or receive gifts or bequests of real or personal property to be applied by it either to principal or income.
(2) 
To appoint an administrator, secretary and/or such employees as it may require and as shall be within the limits of the funds allocated to it and the financial requirements of the programs involved.

A. 
The Borough Council may appropriate funds for expenses incurred by the Arts Commission. Monies received from events sponsored by the Arts Commission shall be returned to the Borough Treasurer. Any unused balance at the end of the fiscal year reverts to the general fund of the Borough.
B. 
Monies received by the Arts Commission as gifts or bequests will be kept in a trust fund until their use is approved by the Arts Commission. Dedicated funds must be spent for the purpose for which the gift was made.

The Arts Commission shall meet on, or immediately after, January 1, of each year for purposes of reorganization. The agenda at this meeting should include election of officers, appointment of committees, adoption of bylaws or rules of procedure, fixing date and place of meetings and such other business as shall properly come before the Commission at the annual reorganization meeting.

The Arts Commission shall keep records of its meetings, activities and finances, and shall make an annual report to the Borough Council.
