As used in this article:
SIDEWALK
Any walkway along a street, avenue or highway, which walkway is commonly used and intended for the use of pedestrians, whether such walkway is paved with concrete or asphalt or marked by flagstone or gravel or merely marked by continuous use.

Properties within the Borough that are presently identified as having walkways which must be cleared of snow and ice are as follows:

All those located on the northerly side from Roseland Avenue to Wootton Road and number 307 on the southerly side
B. 
The Borough Administrator may, after consultation with and at the direction of the Mayor and Borough Council, add or delete properties from this list on an emergency temporary basis.
The owner or owners, tenant or tenants of any land abutting upon the public streets, avenues and highways of the Borough shall remove all snow and ice from the abutting sidewalks of such public streets, avenues and highways within 12 hours of daylight after the same shall fall or be formed thereon, or such longer period as shall be fixed by the Mayor or Borough Administrator in the event of emergency.

In the event of ice which may be so frozen as to make removal impracticable, the owner or owners, tenant or tenants of lands abutting or bordering upon public streets, avenues, or highways shall cause the same to be thoroughly covered with sand, ashes or rock salt within 24 hours after the same shall cease to fall or be formed thereon. The penalty for a violation of this section shall be:
A. 
First offense: $50.
B. 
Second offense: $75.
C. 
Third offense: $100.
D. 
Fourth and subsequent offenses: $150.

Any person, firm or corporation violating any of the provisions of this article shall, upon conviction thereof, be subject to a fine of $50 for the first offense and $100 for the second and subsequent offenses. Each and every twenty-four-hour period that such violation continues shall be considered a separate and distinct offense.
