No person shall cause, suffer, allow or permit open burning of refuse or plant life nor conduct a salvage operation by open burning except as provided in § 94-2. The penalty for a violation of this section shall be:
A. 
First offense: $50.
B. 
Second offense: $75.
C. 
Third offense: $100.
D. 
Fourth and subsequent offenses: $150.

Open burning shall be permitted for the purpose of outdoor cooking where proper equipment or fireplaces designated for such purpose are utilized.

Any person who, by the igniting of any bonfire, brush fire, grass fire, or fire for the burning of leaves, paper or rubbish, makes it necessary for the protection of property from fire or to prevent the spreading of fire to call upon the Borough Fire Department shall, upon conviction thereof, be subject to the penalties in § 94-4.

Any person who violates this chapter shall, upon conviction thereof, be punished as provided in Chapter 1, Article III, General Penalty. A separate offense shall be deemed to have been committed for each day on which a violation occurs or continues.
