The Borough water system, as comprehended in this chapter and in such rules, regulations and resolutions as may from time to time be adopted by the Council, shall consist of all publicly owned or leased property, real or personal, whether within or outside the boundaries of the Borough, devoted to the production, distribution, sale and use of water, wholesale or retail, including easements, rights-of-way and licenses, and also including books of account and other records, and the machines and other equipment used for the collection of water rates and charges.
A. 
The Council shall from time to time, by resolution, prescribe such rules and regulations and policies, general and specific, for the extension, maintenance, repair and operation of the water system, for the purveying of water, wholesale and retail, for the fixing of water rates and fees and charges for inspections, tests, connections and other services rendered water consumers, and for the collection of the same, as it may deem necessary for the proper and efficient management of the water utility, in the interests of the citizens of the Borough and other consumers, wholesale and retail.
B. 
The Council shall further and by resolution designate such committees, officers and employees to carry out the administrative functions of the water utility and perform the duties and services required by the rules, regulations and resolutions as it may from time to time deem necessary and proper.
C. 
The rules, regulations and resolutions of the Council, when duly and properly adopted, shall become and be a part of this chapter by reference, to the same effect and with the same force as if here in full and at length set forth, and any person, firm or corporation violating the regulations, rules or resolutions shall, upon conviction thereof, be subject to a fine not in excess of $100 to be recovered in the Borough Recorder's Court in an action in the name of the Borough.
D. 
Unpaid bills for water furnished, together with such penalties, fees and other charges as may be incurred under the rules, regulations and resolutions of the Council, shall become a lien upon the property served at the time, in the manner, and to the extent provided in the rules, regulations and resolutions and the provisions of the Revised Statutes respecting water liens, and the enforcement of the liens shall be accomplished in the same manner as are liens for unpaid taxes and assessments.
The following rules and regulations shall be considered a part of the contract for water supply made by the Borough with consumers within the Borough, and every such person shall be considered as having expressed his acceptance thereof.
All water charges shall be payable at the office of the Borough Collector quarterly, on the first days of January, April, July and October of each year.
A penalty of 10% of the amount of the bill shall be added to every bill that is not paid within 30 days of the date on which it is due.

If any bill remains unpaid 30 days after it becomes due, the water supply shall be turned off after five days' previous notice has been given, and the water supply shall not again be turned on until all charges have been paid, plus a fee as provided in § 286-37 for restoring the service.

Pro rata charges will be made for periods less than a full quarter, but no rebate shall be allowed for vacancy or nonuse of water unless notice in writing has been given at the office of the Water Superintendent and the water turned off.
Any person who violates any ordinance or regulation adopted by the Borough Council governing the use of water shall be punished as provided in Chapter 1, Article III, General Penalty.
