Where, because of exceptional narrowness, shallowness, existing use of adjacent land or shape of the specific parcel or because of unusual topographic conditions or other unusual physical conditions of the specific parcel, the Planning Board finds that practical difficulty or unnecessary hardship will result from strict application of the requirements of this chapter, it may vary or modify the application of said requirements in the specific case so that substantial justice is done and the public interest secured, provided that such variation or modification does not have the effect of nullifying the intent or purposes of the Master Plan, Chapter
160, Zoning, or this chapter.
Any officer, department, board or bureau of
the Village, with the approval of the Board of Trustees, or any person
or persons, jointly or severally aggrieved by any decision of the
Planning Board concerning such plat or the changing of the zoning
regulations of such land may bring a proceeding to review in the manner
provided by Article 78 of the Civil Practice Law and Rules in a court
of record on the ground that such decision is illegal in whole or
in part. Such proceeding must be commenced within thirty (30) days
after the filing of the decision in the office of the Planning Board.
