Town of Crawford, NY Stop Intersections

It is the intention of the Town Board of the Town of Crawford to combine all laws regulating traffic at the various intersections in the Town of Crawford in one article. It is intended further that, wherever possible, when additional intersections are desired to be controlled, they will be so controlled by amending this article.

Stop signs shall be erected on the following Town roads at an appropriate location at the intersections described. The stop signs shall be erected and maintained by the Town of Crawford.

A.

Except when directed to proceed by a police officer, every driver of a vehicle approaching a stop sign shall stop at a clearly marked stop line, but if none, then shall stop before entering the crosswalk at the point nearest the intersecting roadway where the driver has a view of the approaching traffic on the intersecting roadway before entering the intersection, and the right to proceed shall be subject to the provisions of Subsection B.

B.

Except when directed to proceed by a police officer, every driver of a vehicle approaching a stop sign shall stop as required by Subsection A and after having stopped shall yield the right-of-way to any vehicle which has entered the intersection or which is approaching so closely on said intersection as to constitute an immediate hazard during the time when such driver is moving across or within the intersection.

A.

It is a traffic infraction for any person to violate any of the provisions of this article.

B.

Every person convicted of a traffic infraction for the violation of any of the provisions of this article shall, for a first conviction thereof, be punished by a fine of not less than $50 and not more than $100, or imprisonment of not more than 15 days, or by both such fine and imprisonment; for a second conviction within 18 months thereafter, such person shall be punished by a fine of not less than $100 and not more than $250, or by imprisonment for not more than 15 days, or both such fine and imprisonment; upon a third conviction within 18 months after the first conviction, such person shall be punished by a fine of not less than $250 and not more than $500, or by imprisonment for not more than 15 days, or both such fine and imprisonment.

C.

A conviction of violation of any provisions of this article shall not be a bar to a prosecution for a homicide committed by any person in operation of a motor vehicle or motorcycle.

D.

A person who is charged with a traffic infraction for the violation of any of the provisions of this article may enter a plea of not guilty by mailing to the court or administrative tribunal of appropriate jurisdiction the ticket or other process making the charge and a signed statement indicating such plea. Such plea must be sent by registered or certified mail, return receipt requested, and within 48 hours after receiving such ticket or other process. Upon receipt of such ticket or other process and statement, the court or tribunal shall advise the violator by registered or certified mail, return receipt requested, of the trial or hearing date, which in no event shall be less than seven days after such notice of trial or hearing is mailed.

All prior local laws regulating traffic at intersections in the Town of Crawford are herewith repealed.
