This chapter provides for the regulation and licensing of persons engaged in the business of snow removal in order to promote the health, safety, morals and general welfare of the inhabitants of the Village of Fayetteville.
A. 
No person shall, within the Village of Fayetteville, engage in or carry on the business of snowplowing or snow removal for hire without first having obtained a license therefor as hereinafter provided.
B. 
No person shall hire, contract or otherwise employ an unlicensed snowplow operator to plow or remove snow from private property.
As used in this chapter, unless the context otherwise requires, the following terms shall have the meanings indicated:
SNOWPLOW EQUIPMENT
Any truck, tractor or other vehicle equipped with attachments designed to be used for the removal of snow. Also included shall be snowblowers or other power-driven equipment for the removal of snow.
SNOWPLOW OPERATORS
Any person or business entity which shall carry on the business of removing snow for hire on private property and who uses snowplow equipment in the course of his or her business.
This chapter shall not be held to apply to persons under the age of 18 years who use only snowplow equipment powered by engines rated at less than 20 horsepower.
Any person desiring to procure a license as herein provided shall file with the Village Superintendent of Highways a written application providing the following information:
A. 
The name, address and age of the applicant.
B. 
The number and kind of snowplow equipment to be used in carrying on the business, specifying make, model, color and license number, if any, of such equipment.
C. 
The names of all employees that he or she will employ in the business. It is the duty of the snowplow operator to make sure all of his or her employees comply with the provisions of this chapter.
D. 
Such other information as may be required by the Village Board.
Upon receipt of the application and the license fee therefor, the Village Clerk shall issue a license, which shall expire on the 31st day of May of each year.
The annual license fee for a snowplow operator shall be the sum of $10. In addition thereto, there shall be paid a fee of $5 for each piece of snowplow equipment used in the business. These fees shall cover licensing for the snowplow operator's employees to the extent they are listed on his or her application for license.
Licenses issued under this chapter shall be issued upon and subject to the following conditions:
A. 
That the licensee shall not change or add snowplow equipment or employees to his or her business without first notifying the Village Clerk in writing and paying a registration fee of $5 for each new piece of equipment or group of employees.
B. 
That vehicles and equipment shall be equipped with suitable lighting and warning devices as required by the Vehicle and Traffic Law of the State of New York.
C. 
No one shall plow or remove snow in such a manner that it blocks sidewalks, leaves piles in the roadways, pushes or places snow or other material across any roadway or street onto property other than that being plowed.

D. 
That the licensee will comply with all provisions of this chapter in conducting his business, and that the Village Board may revoke such license for any violation of this chapter or any other provision of this Code.
When it shall appear to the Superintendent of Highways that a licensee has violated any provision of this chapter, the Superintendent of Highways shall be empowered to recommend to the Village Board that such license be revoked.
