For the purpose of the promotion of public health,
safety, morals and general welfare of the Village of Fayetteville,
New York, the Village is hereby divided into the following types of
districts:

A. The Village may establish miscellaneous overlay districts.
The overlay districts shall not impair the applicability of any laws,
ordinances or regulations except as set forth herein or as set forth
in any laws, ordinances or regulations applicable to such overlay
districts. All construction within the Floodplain (FP) Overlay District
shall be by special permit application notwithstanding whether or
not a special permit is otherwise required by this chapter. Land within
such overlay district shall also be subject to such additional requirements
as may be provided elsewhere in this chapter applicable to such districts.
Where there is a conflict between the requirements specifically applicable
to the overlay district, this chapter or any other law, ordinance
or regulation, the more restrictive requirement shall apply.
B. The following miscellaneous overlay districts are
established for the Village:

The exact boundaries of each district shall
be indicated on the Zoning Maps on file in the office of the Village
Clerk. The following general rules shall apply to the precise location
of district boundary lines:
A. Boundaries which approximately follow the center,
right-of-way, perimeter, boundary or other commonly understood reference
line of a street, highway, alley, right-of-way, lot, creek, channel,
river, stream or similar tributary of water shall be construed to
be coincidental with such line.
B. Boundaries which are indicated as being approximately
parallel to such lines shall be construed to be parallel to the same
and at the distance noted on the Zoning Map, or absent a dimension,
at a distance based upon the scale of the Zoning Map.
C. Boundaries which approximately follow the perimeter
of a tributary referred to above which does not have a fixed boundary
line shall be construed to be coincidental with the average high-water
mark established by applicable authority.
D. Boundaries indicated as approximately following the
corporate boundaries of the municipality shall be construed to be
coincidental with such boundaries.
