This chapter shall be known as the "Private Well Testing."
It is hereby determined that:
A. Land use activities, particularly those involving the discharge into
groundwater of contaminants potentially harmful to human health within
the Town of Fishkill and surrounding areas, have given rise to periodic,
localized adverse impacts upon groundwater sources for private wells
not under the regulation of minimum water quality standards of Part
5 of the New York State Sanitary Code ("Sanitary Code");
B. Unknowing exposure to these contaminants resulting from the use of
private wells presents a stealth local health risk which can be lessened
at the local governmental level through means of compulsory testing
of private wells not otherwise covered by Part 5 of the Sanitary Code
and the maintenance and dissemination of test results which, at a
minimum, will provide available sources of notice to members of the
public who might reasonably be expected to consume or make use of
water supplied from potentially contaminated private wells in the
Town; and
C. In addition to promoting the health of actual individuals in the
direct zone of protection of this chapter, as aforesaid, compulsory
private well testing, maintenance of findings, dissemination of findings,
and related recordkeeping of resulting data will promote the public
health, safety and welfare of the Town of Fishkill, and surrounding
area, by providing an informational aid to regulatory agencies directly
involved in the identification, investigation and remediation, where
appropriate, of groundwater contamination threatening public health.
