This article is adopted pursuant to § 1660-a of the
Vehicle and Traffic Law of the State of New York at the requests of
owners of shopping centers in the Town of Fishkill, Dutchess County,
New York.
Upon written request of either the owner or the person in general
charge of the operation and control of a parking area in a shopping
center in the Town of Fishkill (as the terms "parking area" and "shopping
center" are defined in § 1660-a of the Vehicle and Traffic
Law), the following traffic regulations shall be in effect from the
effective date of this article at shopping center parking areas:
A. Parking, standing or stopping of vehicles within areas marked "no
parking" or "fire zone" is prohibited except for vehicles delivering
merchandise. However, if a vehicle is delivering merchandise and parked
in a no-parking or fire zone area, it shall not be left unattended.

B. No vehicles shall stop, stand or park in front of any doorways in
said shopping center, except for vehicles delivering merchandise.
However, if a vehicle is delivering merchandise, it shall not be left
unattended.

C. Those areas set forth in Subsections
A and
B of this section shall be known as "fire lanes" in said parking areas.
D. All other written requests by the owners or persons in general charge
of the operation and control of a parking area, driveway, private
street or roadway of a shopping center or by the Fire Chief of the
Fire Department serving such area in the Town of Fishkill (as the
terms "parking area," "driveway," "private street," "roadway" and
"shopping center" are defined in § 1660-a of the Vehicle
and Traffic Law of the State of New York) to regulate traffic by the
erecting of proper traffic control signs or to establish minimum speed
limits or safety zones pursuant to § 1660-a of the Vehicle
and Traffic Law shall be considered by the Town Board, and, if found
to be necessary, the right to erect such signs and establish such
speed zones or safety zones shall be done by resolution of the Town
Board. The cost of erecting and maintaining these traffic control
devices shall be borne by the owner or owners of the property.

E. Parking in areas designated for handicapped parking shall be by permit
only.

F. No vehicle that fails to display a valid certificate of inspection
or that fails to display a set of number plates shall park, stand
or stop in a shopping center parking area.

Any vehicle parked or abandoned in said fire lanes during snowstorms,
floods, fires or other public emergencies shall be removed upon the
order of the Town Superintendent of Highways to the Town of Fishkill
garage and may not be recovered except upon payment to the Town Clerk
of all expenses incurred in the removal and storage of said vehicle
by the owner or operator of same.

Any violation of this article shall be subject to the penalties set forth in Article
VIII of this chapter.
