All solid waste generated in the City of Geneva,
shall be delivered for disposal to the Ontario County Landfill in
the Town of Seneca.

Any dangerous, harmful or deleterious substances
originating in the City of Geneva which cannot be disposed of in the
Ontario County Landfill Site #1 shall be disposed of in accordance
with all applicable laws, ordinances, rules and regulations of the
state and federal governments and any other authority having jurisdiction
over same.

A.
Recyclable and salvageable material. Notwithstanding the foregoing,
any recyclable or salvageable material shall be collected and stored
in a clean and sanitary manner and shall be disposed of for recycling
or salvaging pursuant to all applicable laws, ordinances, rules and
regulations of the state and federal governments and any other authority
having jurisdiction over same.
B.
The inspection program will be a spot inspection type of program
(initially an average of 10 inspections per month or less) and designed
to identify egregious instances where recycling and trash for the
landfills are comingled in a single container making it difficult
for efficient and sanitary pick-up by a licensed trash hauler. Prior
to initiating spot inspections, City staff will develop a City-wide
education campaign regarding proper waste disposal and recycling practices.

It shall be presumed that any ashes, rubbish
and trash originating in the City of Geneva and placed in vehicles
used by licensed refuse collectors for collection are disposable in
the Ontario County Landfill Site #1 and it shall be the burden of
the person asserting that any ashes, rubbish or trash originating
in the City of Geneva are not disposable in the Ontario County Landfill
Site #1, to establish same in a court of competent jurisdiction.
