The provisions of this article shall apply except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with directions of a police officer or official traffic control device.
A. 
No person shall park any vehicle on the following streets, namely: Main Street between Seneca Street and Castle Street; Castle Street between Main Street and the Penn Central Railroad; Seneca Street; Linden Street; Exchange Street between Lewis Street and East Washington Street in the City of Geneva between 2:00 a.m and 6:00 a.m.
B. 
Time limit parking.

(1) 
Except as otherwise prohibited or restricted by other provisions of this Code now or hereafter adopted, the parking of vehicles between the hours of 2:00 a.m. and 6:00 a.m on Genesee Street between Lewis Street and North Street; on North Genesee Street between North Street and Wilbur Avenue; on South Main Street from William Street southerly to its termination will be permitted on the east side of the street on Monday, Wednesday, Friday and Sunday; on the west side of the street on Tuesday, Thursday and Saturday.
(2) 
Except as otherwise prohibited or restricted by other provisions of this Traffic Code now or hereafter adopted, the parking of vehicles between the hours of 2:00 a.m. and 6:00 a.m. on Castle Street from Main Street to Brook Street will be permitted on the south side of the street on Monday, Wednesday, Friday and Sunday; and on the north side of the street on Tuesday, Thursday and Saturday except for that portion of Castle Street lying between Oak Street and Maxwell Avenue where the parking of vehicles on both sides of the street during all hours of the day will be permitted from April 1 to December 1.

(3) 
Except as otherwise prohibited or restricted by other provisions of this Traffic Code now or hereafter adopted; the parking of vehicles between the hours of 2:00 a.m. and 6:00 a.m. on Lewis Street from Exchange Street to Genesee Street will be permitted on the north side on Monday, Wednesday, Friday and Sunday; on the south side of the street on Tuesday, Thursday and Saturday.

(4) 
Except as otherwise prohibited or restricted by other provisions of this Traffic Code now or hereafter adopted, the parking of vehicles between the hours of 2:00 a.m. and 6:00 a.m. on Milton Street will be permitted on the north side of the street on Monday, Wednesday, Friday and Sunday; on the south side of the street on Tuesday, Thursday and Saturday.

(5) 
Except as otherwise prohibited or restricted by other provisions of this Traffic Code now or hereafter adopted, parking shall be restricted on Rose Street to provide for no parking on the east side of Rose Street between the hours of 2:00 a.m. and 6:00 a.m. on Tuesdays, Thursdays, and Saturdays, between December 1 and April 1. Additionally, no parking is permitted on the west side of Rose Street, except on Tuesdays, Thursdays, and Saturdays, between December 1 and April 1.

(6) 
Except as otherwise prohibited or restricted by other provisions of this Traffic Code now or hereafter adopted, the parking of vehicles on the north side of Hogarth Avenue will be permitted on Monday, Tuesday, Wednesday, Thursday, Friday, Saturday and Sunday, except during the months of December, January, February and March during the hours of 2:00 a.m. and 6:00 a.m.

C. 
No vehicles shall be parked on any other street in the City of Geneva between the hours of 2:00 a.m. and 6:00 a.m. during a weather event except during the months of April, May, June, July, August, September, October and November.

(1) 
Weather event regulations.
(a) 
For purposes of this article, a weather event shall be defined as a period of snow, sleet, freezing rain, ice, and any other weather event which results or reasonably can be expected to result in accumulation upon a street or highway of snow or ice. A weather event shall continue until such time as the City streets are fully cleared.
(b) 
A weather event shall be declared by the City Manager or a designated person after consultation with the City Director of Public Works and the Chief of Police. A declaration of a weather event may include specific directions to the Department of Public Works and the Police Department concerning how the weather event regulations shall be enforced. In the absence of such a direction from the City Manager, the City Director of Public Works and the Chief of Police shall determine how the weather event regulations shall be enforced.
(c) 
Official notification of a weather event will be posted on the city website and through alternative notification and social media systems.
(d) 
It shall be unlawful and a violation of this article for any person to park or leave standing any vehicle on any of the public streets or state highways maintained by the City of Geneva within the confines of city limits during a weather event while the Department of Public Works plows, salts or engages in other activities to clear City streets and highways.
(2) 
State of emergency.
(a) 
In the event the State of New York or any other authority declares a state of emergency due to serious snow, ice or similar events which is communicated to the public through the news or other media, the notice requirements of this article shall not apply, and any vehicle found parked or standing on or upon a public street or state highway maintained by the City of Geneva within the confines of City limits shall be removed at the owner's expense, without any prior notice, and in accordance with the City's ordinance governing the removal and impounding of vehicles, and all applicable rules and regulations governing removal and impounding of vehicles. No official notification by the City shall be required if a state of emergency is declared by the State of New York.
(3) 
Enforcement.
(a) 
In addition to enforcement provisions set forth above, the provisions of Article VI of this chapter pertaining to weather events and states of emergency shall be enforced in accordance with the provisions of this Code, including but not limited to § 335-27 and Article VII of this chapter. In the event the City is obligated to institute or defend a civil complaint arising out of enforcement, all attorneys' fees, disbursements and costs incurred by City of Geneva with respect to instituting or defending such action shall be the responsibility of the violator.
(b) 
Any vehicle found parked or standing on or upon a public street or state highway maintained by the City of Geneva within the confines of City limits during a weather event or a state of emergency, shall be removed at the owner's expense, without any prior notice, and in accordance with the City's ordinance governing the removal and impounding of vehicles set forth in § 335-27A and C, and all applicable rules and regulations governing removal and impounding of vehicles.

A.

B. 
Handicapped persons shall have the right to park in those parking spaces designated by the Police Department by proper signs indicating "Handicapped Parking Permitted."

(1) 
A "handicapped person," for the purpose of this section, shall mean any person who has any one or more of the following impairments, disabilities or conditions which are permanent in nature:
(a) 
Has limited or no use of one or both lower limbs.
(b) 
Has a neuro-muscular dysfunction which severely limits mobility.
(c) 
Has a pulmonary or cardio-vascular condition which limits mobility or severely limits the individual's activities in the open air.
(d) 
A person whose physical or mental impairment or condition is other than those specified above, but is of such nature as to impose unusual hardships in utilization of public transportation facilities and such condition is certified by a physician duly licensed to practice medicine in this state as constituting an equal degree of disability (specifying the particular condition) so as to prevent such person from getting around without great difficulty.
(e) 
A child with any one or more of the impairments or conditions listed above.
(2) 
Such handicapped person shall have a valid permit issued by the Police Department that provides such medical certification together with such other information as requested by the Police Department to obtain a handicapped parking permit which must be displayed on the vehicle parked by a handicapped person in the designated reserved parking space.
(3) 
Such handicapped person possessing a valid permit issued by a police department or other agency under the laws of the State of New York and such municipality and who displays such permit in the same manner as above stated shall be entitled to such parking, but must adhere to existing parking regulations and ordinances regarding alternate parking or any other parking prohibition now in effect.

(4) 
Any person who parks in spaces clearly marked for use by the handicapped in accordance with this section without a special use parking permit or whose motor vehicle is not registered in accordance with § 404-a of the Vehicle and Traffic Law of the State of New York and being used for the transportation of a handicapped person shall be subject to a fine of $50 for the first offense and $100 for the second offense occurring within a period of two years. The failure of such owner or operator to make such payment to the City Comptroller as required shall render such owner or operator subject to the penalties hereinafter provided for a violation of the provisions of this chapter.

C. 
On all sections of College and VerPlanck Streets where parking is permitted under § 335-17 of this chapter, parking shall be restricted to those vehicles displaying a City-issued permit.

(1) 
The City shall issue two parking permits to each property owner on each street.
(2) 
Property owners shall cause said permits to be applied to any vehicle they wish to be permitted to park on the street.
(3) 
Owners of vehicles parked on the street without displaying said permit shall be subjected to a fine of $100 for the first occurrence and $250 for each subsequent occurrence.
A. 
The parking of trailers or semi-trailers on any highway or public parking lot in the City is prohibited at all times when the motivating power of such trailer or semi-trailer is detached from the same.
B. 
No boat trailer, whether or not affixed to a powering vehicle, shall park in any public parking lot, or at the Lakefront Park, except as posted. From April 1 through October 31, parking is permitted by permit only; said permit to be clearly displayed. Failure to obtain or display said permit shall result in a fine of $20 for the first occurrence, and $50 for each occurrence thereafter.

C. 
Recreational vehicles, including campers over 20 feet in length, shall be prohibited from parking on any street or public parking lot in the City for more than 48 hours. Waivers may be granted in exceptional circumstances by the City Manager for up to a period of seven days.
