The purpose of this article is to fix and establish fees and regulations concerning the disposal of bulky waste by residents of the Borough during the annual spring trash collection period established by the Borough Council and to provide penalties for violation of any of the provisions set forth in this article.
For the purpose of this article, the following definitions shall apply:
BULKY WASTE
Large items of waste material such as appliances, furniture, general household debris, waste building materials and rubble, discarded vehicle parts, etc. (referred to as waste type 13 in the Essex County Solid Waste Management Plan).
SPRING TRASH COLLECTION PERIOD
Those days each year (usually in June) designated by the Borough Council for the collection of bulky waste from Essex Fells residents.
A. 
The Borough Administrator is authorized and directed to establish and promulgate reasonable regulations as to the manner, days and times for the collection of bulky waste and to designate who shall be the designated hauler and also the procedure for obtaining permits for collection.
B. 
Application for the permit shall be made in the office of the Borough Clerk on forms supplied by that office. A new permit must be obtained each year.
C. 
Applicants must furnish proof in a manner satisfactory to the Borough Clerk that they are residents of Essex Fells.
D. 
Following the permit deadline, the designated hauler shall schedule pickup at the address for which the permit is issued.

A. 
The annual fees for permits to dispose of bulky waste during the Borough's spring trash collection period are fixed as follows: one load of a truck holding approximately four yards of bulky waste: $50.
B. 
Following the permit deadline, if the hauler agrees to schedule additional permits, a late fee will be imposed of $20.
C. 
Only one such load shall be permitted from any address.
D. 
These fees must be paid in advance.
A. 
Valid dates. The permit shall be valid only during the designated dates of the Borough's annual spring trash collection program.
B. 
Nontransferable. The permit may only be used at the address for which the permit is issued.
C. 
Revocable. The permit issued under the terms and conditions of this article may be revoked immediately for the violation by the one holding the permit of any provision of this article.
The Essex Fells Police Department is generally authorized and directed to enforce the provisions of this article.

Any person, commercial or institutional establishment who violates or neglects to comply with any provisions of this article or any regulation promulgated pursuant thereto shall, upon conviction thereof, be punishable as provided in Chapter 1, Article III, General Penalty.
