Pursuant to authority granted by the Vehicle
Code of the Commonwealth of Pennsylvania, as the same is amended from
time to time, active members of the fire police, as appointed pursuant to Article
II of this chapter, are hereby authorized to install and maintain, at their own expense, blue lights on their private vehicles, subject to the requirements of state law applicable thereto. Except as provided herein, no other active or inactive members of the fire companies comprising the Fire Department of the Borough of Carlisle shall be authorized to install and/or use such lights.
At any time, and in its sole discretion, the
Borough Council shall have authority to rescind the authorization
granted to any member of the fire police to use such blue light on
his or her automobile or truck and shall report any such change to
the Fire Chief, the Police Chief and the proper authorities of the
Commonwealth of Pennsylvania, and such change shall thereupon become
effective. The Borough Council may make such regulations as it deems
necessary relative to the installation and operation of such blue
lights that are not inconsistent with the provisions of this article,
other ordinances of the Borough of Carlisle and laws of the Commonwealth
of Pennsylvania.
Such blue light shall be operated on the private
vehicles of authorized members of the fire police only at such time
as such members are actually engaged in answering fire or other duly
authorized calls in their private vehicles and shall not be operated
by them at any other time. Borough police shall permit such authorized
members of the fire police to pass expeditiously through traffic and
restricted areas as emergency vehicles and shall render all necessary
assistance to enable such authorized members to reach the scene of
a fire, other civil emergency or other authorized response, and park
conveniently thereat, provided that such authorized members of the
fire police shall at all times be required to observe the traffic
laws of the Commonwealth of Pennsylvania and of the Borough of Carlisle,
and the authority granted in this article does not constitute authority
to them to violate any such traffic laws.
