It is the purpose of this article to establish a fee system to defray costs incurred by the Borough when reviewing and processing a petition submitted by a private party, requesting Borough Council to vacate any public street, alley, right-of-way or portion thereof.[1]

A. 
Said fee noted in § 223-45 above shall be as set forth in Chapter 120, Fees, as enacted and ordained, and as may be, from time to time, amended.
B. 
No petition for vacating a Borough street, alley, right-of-way or any portion thereof shall be accepted and processed by the Borough until a vacating fee has been paid in full by the petitioner.[2]

C. 
Any expense incurred by the Borough for other professional assistance, including legal, advertising and engineering fees, in reviewing and/or processing a petition shall be paid by the petitioner in addition to the fee established herein.
