It shall be unlawful for any person to occupy any parked motor vehicle
on any public road, street, highway, alley or right-of-way within the Borough
of Carlisle, Cumberland County, Pennsylvania, for the purpose of permanent
or temporary living accommodations between the hours of 10:00 p.m. and 6:00
a.m.
As used in this chapter, the following terms shall have the meanings
indicated:
MOTOR VEHICLE
Every device in, upon or by which any person or property is or may
be transported or drawn upon a highway.
OCCUPY
To stay or remain in or utilize for living accommodations. "Occupy
for the purpose of temporary living accommodations" shall not be construed
to mean a brief and momentary occupancy of a motor vehicle for less than five
minutes in total length of time.
It shall be presumed that a person has occupied a motor vehicle for
the purpose of temporary living accommodations if he remains in the parked
motor vehicle after being advised by a police officer of the Borough of Carlisle
of the existence of this chapter. However, the giving of such notice is not
a prerequisite for the filing of charges for violation of this chapter.

Any person violating any provision of this chapter shall, upon conviction
before a District Justice in a summary proceeding, be sentenced to pay a fine
of not more than $600, together with the costs of prosecution, and, in default
of payment of such fine and costs, to undergo imprisonment in the Cumberland
County Prison, Carlisle, Pennsylvania, for a period of not more than 30 days.
