The boundary limits of the Borough of Chambersburg are hereby established as a zone in which motor vehicles may park without lights, and all highways within such boundary limits are hereby designated as highways where motor vehicles may remain parked without lights.
Wherever a space shall be marked off on any highway for the parking of an individual vehicle, every vehicle there parked shall be parked within the lines bounding such space.

Only angle parking shall be permitted on the following portions of the highways:

A.
No person shall park or leave on the streets, highways or public property of the Borough any mechanically inoperable vehicles or vehicles without current registration plates.
B.
No person shall park or leave on the streets, highways or public property of the Borough any vehicle without a current inspection sticker unless the vehicle is legally parked in front of, or in close proximity to, an official Pennsylvania state inspection station, which inspection station identifies such vehicle by work order specifying a state inspection shall be performed within 48 hours. Additional work orders beyond the initial forty-eight-hour period are prohibited.[1]

C.
Penalties for violation of Subsection A.
(1)
Any person and/or entity violating Subsection A of this section shall, upon conviction thereof, be guilty of a summary offense and sentenced to pay a fine of not more than $200 plus court costs and reasonable attorney fees and, in the event of default of payment, such violator may be sentenced to imprisonment for a period not to exceed five days. Each day and/or each violation by the same person and/or entity shall be considered a new and separate violation of the Code of the Borough of Chambersburg.
(2)
Borough police officers and peace officers as defined herein are hereby duly authorized to issue a ticket in the form established by the Borough to any person and/or entity violating the provisions of Subsection A of this section. The ticket shall instruct such violator that if he, she, or it reports to the Borough office and pays the Borough the sum of $50 within 72 hours of the date of issuance of the ticket, then such payment shall have the violator through prosecution by a citation, which prosecution may result in court costs and attorney fees being assessed against the violator in addition to the fine.
(3)
Notwithstanding the above, any police officer or peace officer shall have the sole and absolute discretion to issue a citation without first issuing a ticket as provided for herein.
D.
Penalties for violation of Subsection B.
(1)

(2)

A.
The following vehicles shall not be parked, between the hours of 9:00 p.m. and 6:00 a.m., except while loading or unloading the vehicle, on any street within the Borough of Chambersburg that is zoned residential:
(1)
Any bus, truck tractor, farm equipment, or trailer (with or without having a vehicle attached), or any combination thereof, as defined by the Pennsylvania Vehicle Code, 75 Pa.C.S. § 101 et seq.; and
(2)
Any food truck, mobile food facility, or other vehicle or trailer equipped to prepare, serve, and/or sell food.
B.
No motor home, truck-camper, or house coach, as defined by the Pennsylvania Vehicle Code, 75 Pa.C.S. § 101 et seq., shall be parked for a period longer than 72 hours on any street within the Borough of Chambersburg that is zoned residential. No motor home, truck-camper, or house coach shall be used as a dwelling place, living abode, or sleeping place on any street in the Borough of Chambersburg.
C.
For purposes of calculating the time a vehicle has remained parked on a residential street and/or for purposes of designating the occasion on which the same has been parked, temporarily moving the vehicle or relocating the same to some other point within the same city block shall not be considered sufficient to begin a new measurement of time.
D.
For purposes of determining whether a street is zoned residential, any public right-of-way adjacent to or wholly within a residential zoning district is herein considered zoned residential.
E.
Temporary tradesperson permits. Tradespersons conducting construction upon or arranging moving/relocation services from any residential property within any residential zoning district of the Borough shall be eligible to obtain a temporary permit for one vehicle or trailer associated with the tradesperson, from the Borough Secretary during regular office hours, for a period not to exceed 20 consecutive business days, at a cost to be established from time to time by resolution of Town Council and set forth on the Borough's Master Fee Schedule. Said permits shall permit parking on the street for those days at a specific address and will not be extended regardless of circumstances. The Borough Secretary shall provide the Chambersburg Police Department with a list of permittees. Permits shall not be used for customer parking at businesses or employee parking for personal vehicles for tradespeople. Enforcement of this Subsection E is at the discretion of the Chambersburg Police Department.

Any person and/or entity violating any and/or all of §§ 286-22 to 286-33 and § 286-36, and except § 286-31, of Article III shall, upon conviction thereof, be guilty of a summary offense and sentenced to pay a fine of not more than $25 plus court costs and reasonable attorney fees and, in the event of default of payment, such violator may be sentenced to imprisonment for a period not to exceed five days. Each day and/or each violation by the same person and/or entity shall be considered a new and separate violation of the Code of the Borough of Chambersburg.
B.
Borough police officers and peace officers as defined herein are hereby duly authorized to issue a ticket in the form established by the Borough to any person and/or entity violating any and/or all of §§ 286-22 to 286-33 and § 286-36, and except § 286-31, of Article III. The ticket shall instruct such violator that if he, she, or it reports to the Borough office and pays the Borough the sum of $25 within 72 hours of the date of issuance of the ticket, then such payment shall save the violator through prosecution by a citation, which prosecution may result in court costs and attorney fees being assessed against the violator in addition to the fine.
C.
Notwithstanding the above, any police officer or peace officer shall have the sole and absolute discretion to issue a citation without first issuing a ticket as provided for herein.

Parking, standing or stopping in violation of the provisions of the Pennsylvania Vehicle Code, 75 Pa.C.S.A. § 101 et seq., as amended, which said provisions are hereby incorporated by reference, is prohibited. The Borough of Chambersburg, its police officers and its peace officers shall have discretion as to whether to issue a parking ticket in an amount as promulgated in this Chapter 286 of the Code of the Borough of Chambersburg or a citation pursuant to the Pennsylvania Vehicle Code.

B.
The portions of the streets designated above shall be posted with a minimum of two signs per side of street per block notifying the public that, except on Saturdays, Sundays and legal holidays, parking is prohibited between 7:00 a.m. and 4:00 p.m. except with a residential parking permit.
C.
The issuance of a permit to any person for any motor vehicle shall not be construed to reserve a parking space along the above-designated portions of such streets for that vehicle at any time.
D.
Parking on residential parking permit streets. It shall be a violation of this § 286-36 for any person to park or leave standing a motor vehicle on any of the portions of the streets designated in Subsection A above on days other than Saturdays, Sundays and legal holidays between the hours of 7:00 a.m. and 4:00 p.m. unless such vehicle displays a current residential parking permit of one of the types, and in the location, hereinafter set forth in this section.
E.
Types of permits.
(1)
The following types of residential parking permits may be issued:
(a)
Resident permit: a permit issued to residents for use only on the motor vehicle for which it is issued.
(b)
Visitor permit: a permit issued to residents for temporary use only on the vehicles of visitors to their residences.
(c)
Trades permit: a permit issued to residents for temporary use only on the vehicles of tradesmen working at their residences.
(2)
The permits shall be of the types determined by the Borough Treasurer and shall be displayed by hanging from the rearview mirror. If mirror design prohibits the hanging of the permit, the permit shall be displayed on the left side of the dashboard of the motor vehicle authorized to use the same so that the permit is clearly visible through the windshield.
(3)
It shall be a violation of this section for any person to use or display a permit or to make available or permit its use or display in or on a vehicle not authorized or entitled hereunder to use or display the same.
F.
Application for permits.

(1)
The fee for residential, visitor, and trade permits will be assessable by the Borough for the administration and enforcement undertaken pursuant to this article and the Code, and shall be established by the Borough by resolution from time to time. Current fee schedules are available from the office of the Borough Secretary.
(2)
The application for a resident permit shall contain the following information:
(a)
The name and resident address of the owner of the motor vehicle for which the permit is sought and, if the person in possession of the vehicle is other than the owner, the name and residence address of that person;
(b)
The make, model and registration (license plate) number of that motor vehicle;
(c)
The driver number of the person in possession of the vehicle for which the permit is sought as taken from that person’s current driver’s license; and
(d)
How many current resident permits have been issued to such applicant and to the dwelling unit in which the applicant resides; and
(e)
No more than two resident permits may be granted to any person; no more than four resident permits to persons residing in one dwelling unit. Resident permits are valid only for a vehicle of the applicant for which the application is specifically made.

(3)
The application for a visitor permit shall contain the following information:
(a)
The name and residence address of the applicant;
(b)
Whether the applicant has been issued a resident permit; and
(c)
The number of current visitor permits issued to residents of the applicant’s dwelling unit; and
(d)
Not more than a total of two visitor permits shall be issued to persons residing in any one dwelling unit.

(4)
The application for a trades permit shall contain the name and residence address of the resident applicant.
(5)
The Borough Treasurer may require satisfactory proof of all information set forth on any application and any other information deemed necessary.
(6)
Upon receipt of the application and permit fee and determination that the information upon the application indicates that the applicant is entitled to the requested permit, the Borough Treasurer shall issue the same, which shall be valid until August 31 next following. The permit shall be renewable at any time prior to its expiration date for a period of one year beginning on the day following its expiration date, so long as the Borough Treasurer is satisfied that there have been no changes in the information set forth on the application.
(7)
It shall be a violation of this section for any person to submit incorrect information on an application for a permit or it seeking a renewal thereof.
G.
Disposal of motor vehicle. If a person to whom a resident permit is currently issued sells or otherwise disposes of the motor vehicle for which that permit has been issued, such person shall remove the decal permit and return it to the Borough Treasurer. If such person replaces that vehicle with another during the then-current period of such permit, the Borough Treasurer shall, on application therefor, issue a replacement permit of the same type for that motor vehicle for the balance of the period without another application fee being paid.
H.
Forfeiture of permit. In addition to the other penalties provided in this chapter, the Borough Treasurer may declare a residential parking permit to be forfeited for any violation of this section by the holder thereof and require the permit to be delivered to the Finance Department.

At no time shall repair work on any motor vehicle be done or performed on any part of the Borough street system (including alleys and state routes within the Borough) as well as all Borough-owned or Borough-leased parking areas. When a vehicle is inoperable, only emergency repairs such as changing a flat tire or jump-starting a battery may be performed. Maintenance such as changing oil is not permitted.
A.
Enforcement. It shall be discretionary with the officer whether to choose to issue a ten-dollar parking ticket under this chapter or a citation under the Pennsylvania Vehicle Code.
B.
The penalty for violation under this section shall be from a minimum of $50 to a maximum of $300, if a citation is issued.

A. AUTHORIZED PERSONNEL BOOTING INDICIA OF OWNERSHIP
Definitions. As used in this section, the following terms shall have the meanings indicated:
Police officers of the Borough of Chambersburg and/or any designees thereof who are authorized by the Chief of Police to engage in the enforcement of parking and traffic ordinances of the Borough of Chambersburg.
The act of immobilizing a motor vehicle in such a manner as to prevent its operation; provided, however, that no such vehicle shall be immobilized by any means other than by the use of a device or other mechanism which will cause no damage to such vehicle unless it is moved while such device or mechanism is in place, and which device is certified as acceptable by the Police Department.
Any identifying card and plate or plates issued to evidence authority for a motor vehicle to be operated on a public street or highway, or a certificate of title issued to evidence that a person, other than a lienholder, has the property right in or title to a motor vehicle.
B.
Vehicles subject to booting. Any motor vehicle ("violating vehicle") which has more than $50 of unpaid fines and costs for parking and/or traffic violations issued by the Borough of Chambersburg for which citations and/or warrants have been filed by a District Justice of Franklin County ("fines and costs") is subject to booting by authorized personnel.All motor vehicles owned by the owner of a violating vehicle shall also be subject to booting. All unpaid fines and costs on all vehicles owned by the owner of a violating vehicle must be paid in full before the vehicles are no longer subject to booting.

C.
Notice of booting. Each subject vehicle shall be placarded, in a conspicuous manner, with a standard form indicating the dollar amount of the outstanding violations and the procedure to which the owner must adhere in order to have the boot removed, and such placard shall provide notice sufficient to warn any individual that the subject vehicle has been booted and that any attempt to move such vehicle will result in damage to such vehicle.
D.
Procedure to remove boot. Upon payment of all the aforesaid fines, penalties and costs or proper administrative adjudication concerning all such outstanding violations, and upon payment of a booting fee in such amount as set by Council by resolution, the boot mechanism shall be removed as promptly as reasonable and in no event to exceed a twenty-four-hour period; provided, however, that the time provision described herein is subject to extension in the event that the Borough of Chambersburg experiences a civil emergency as declared by the Mayor which prevents authorized personnel from adhering to the stated time provision.
E.
Procedure after booting.
(1)
Where the owner of a booted vehicle fails to make all payments or secure administrative adjudication from the Borough Manager (or his designee) that the booting is improper under this chapter herein within 48 hours from the time the vehicle is booted, said vehicle becomes subject to being towed. To receive information regarding the location of a vehicle which has been towed, the owner shall call the telephone number designated on the placard; a towed vehicle shall be released to the owner, subject to a showing of appropriate indicia of ownership, only after full payment of the fines, costs, penalties and fees for which the vehicle was towed plus towing and storage fees, provided that proper administrative adjudication or judicial order shall be a satisfactory mechanism for release of the vehicle.
(2)
In the event that a vehicle is towed pursuant to the provisions of this section, within 12 hours from the time of towing of such vehicle notice of the fact that such vehicle has been towed shall be sent by the Police Department through certified mail to the owner of record of such vehicle, designating the place from which such vehicle was towed, the reason for its being towed, the amount of fines, costs, penalties and fees owed by said owner as a result of immobilization and subsequent towing and the name and address of the place of impoundment.
(3)
If the vehicle is not reclaimed by the owner from the Borough within 30 days of the initial booting of the vehicle, the Borough shall proceed in accordance with the provisions of Chapter 73 of the Vehicle Code related to abandoned vehicles.
