The American Telegraph and Telephone Company
of Pennsylvania, its successors and assigns may acquire, occupy and
use such portion of the aerial and underground works now in place
or hereafter erected and constructed by the Bell Telephone Company
of Pennsylvania, its successors and assigns on, over, along, in, under,
through and across the public highways of the Borough of Chambersburg
as may be required by said American Telegraph and Telephone Company
of Pennsylvania for connecting and through line purposes in the due
conduct and prosecution of its business, upon such arrangements as
the two companies may agree to.
The American Telegraph and Telephone Company
of Pennsylvania shall at all times fully indemnify, protect and save
harmless the Burgess and Town Council of the Borough of Chambersburg
from and against all actions, claims, suits, damages and charges and
against all loss and necessary expenditures arising from the use or
maintenance of any and all of the aerial and underground works acquired
by it as aforesaid.
Nothing contained in this ordinance shall give
to the American Telegraph and Telephone Company any rights or privileges
to erect and maintain any poles, lines, conduits, wires or other electrical
equipment in the Borough of Chambersburg, but this ordinance shall
only give to it the right to use such lines and wires, either aerial
or underground, of the Bell Telephone Company as it may have now in
place or may hereafter construct in accordance with the franchise
from the Burgess and Town Council of the Borough of Chambersburg now
held by it or in accordance with any franchise hereafter granted to
it by the Burgess and Town Council of the Borough of Chambersburg.
